I would be screwed because just like I sleep walk, I take off cpap mask in my sleep. Luckily they have documentation of it when I went for the sleep study with it on (after the one saying I needed it) and I was recorded taking it off 14 times while the attendant kept putting it back on.

Note: Starting January 30, 2012 and no later than January 30, 2014, all CDL holders must provide information to their SDLA regarding the type of commercial motor vehicle operation they drive in or expect to drive in with their CDL. Drivers operating in certain types of commerce will be required to submit a current medical examiner’s certificate to their SDLA to obtain a “certified” medical status as part of their driving record. CDL holders required to have a ”certified” medical status who fail to provide and keep up-to-date their medical examiner’s certificate with their SDLA will become ”not-certified” and they may lose their CDL.

What is changing? State driver licensing agencies (SDLAs) will be adding your medical certification status and the information on your medical examiner’s certificate to your Commercial driver’s license system (CDLIS) record.

When does this change start? This change starts on January 30, 2012.

What is not changing? The driver physical qualification requirements are not changing.

What are CDL holders required to do?

You must determine what type of commerce you operate in. You must certify to your SDLA to one of the four types of commerce you operate in as listed below,
Interstate non-excepted: You are an Interstate non-excepted driver and must meet the Federal DOT medical card requirements (e.g. – you are “not excepted”).

Interstate excepted: You are an Interstate excepted driver and do not have to meet the Federal DOT medical card requirements.

Intrastate non-excepted: You are an Intrastate non-excepted driver and are required to meet the medical requirements for your State.

Intrastate excepted: You are an Intrastate excepted driver and do not have to meet the medical requirements for your State.
If you are subject to the DOT medical card requirements, provide a copy of each new DOT medical card to your SDLA prior to the expiration of the current DOT medical card.”

According to DOT ( Department of Transportation) Rules and regulations
If you are diagnosed with OSA and are left untreated OR not following your treatment regimen , Your DOT driver’s certificate can/will be withdrawn. ( Basically you have failed your DOT physical)

DOT Health and Safety Guidelines

Are your drivers compliant with current medical fitness standards?

The Department of Transportation, Federal Motor Safety Administration (FMCSA) recently proposed updates to existing guidelines regarding compliance with medical fitness standards related directly and indirectly to respiratory dysfunctions, including sleep apnea.

Physical qualifications, related to respiratory dysfunction for drivers, state that “a person is physically qualified to drive a commercial motor vehicle (CMV) if that person has no established medical history or clinical diagnosis of a respiratory dysfunction likely to interfere with his/her ability to control and drive a commercial motor vehicle safely. If the medical examiner detects a respiratory dysfunction, that in anyway is likely to interfere with the driver’s ability to safely control and drive a commercial motor vehicle, the driver must be referred to a specialist for further evaluation and therapy.”3

Approval by Driver Wellness & Safety and/or the Medical Advisory Board is required if you have any of the conditions listed below. If you have a listed condition and you are applying for a learner’s permit, you must have approval prior to the issuance of the permit. If your driver’s license has been revoked and you have asked to have it reinstated, you may be referred by the MVA for review by Driver Wellness and Safety and/or the Medical Advisory Board.

1. Cerebral Palsy;
2. Diabetes requiring insulin;
3. Epilepsy;
4. Multiple sclerosis;
5. Muscular dystrophy;
6. Irregular heart rhythm or heart condition;
7. Stroke, ministroke, or transient ischemic attack (TIA);
8. Alcohol dependence or abuse;
9. Drug or substance dependence or abuse;
10. Loss of limb or limbs;
11. Traumatic brain injury;
12. Bipolar disorder;
13. Schizophrenic disorders;
14. Panic attack disorder;
15. Impaired or loss of consciousness, fainting, blackout, or seizure;
16. Disorder which prevents a corrected minimum visual acuity of 20/70 in each eye and a field of vision of at least 110 degrees;
17. Parkinson’s disease;
18. Dementia, for example, Alzheimer’s disease or multi-infarct dementia;
19. Sleep disorders, for example, narcolepsy or sleep apnea; or
20. Autism.

For a variety of other reasons, your name also may be given to the MVA for possible referral to the Board, by any of the following:

* Law enforcement agencies
* Judges or attorneys
* Private physicians, hospitals or health care providers
* Complaints from private citizens (after investigation by the MVA)

If you are referred, the MVA’s Driver Wellness and Safety Division (DW&S) will send you an information packet indicating additional information needed from you. The DW&S may then decide to refer you for an MAB evaluation.

The MAB does not perform medical examinations. The physician evaluating your situation primarily depends upon reports from your physician or treatment source. However, the physician may ask you to come in for an interview.

I understand about disability, no dispute. Many of these conditions (dementia, autism, low vision/blindness, etc.) can be diagnosed and driving prohibited. It’s the spying that is objectionable. The OP mentioned a CPAP. CPAP is often used for sleep apnea. I don’t see any great interference with driving.

I just got one too. It has a memory chip but it is not monitored by anybody as far as I know.

There may be something to do that in the latest machines to prevent a Smart Meter from shutting them down.

That would be a waste of technology and money as it wouldn't do any good if a drunk were to knock down the power pole at the end of the block, or an electrical storm knocked out a substation. If you are really dependent on a CPAP/BPAP machine (life and death) you need to invest in a UPS to carry your machine through an outage.

I was on BiPAP for a number of years and was on a "special needs" list with the electric company. They were supposed to put your service back in service as a top priority. After a couple of years they notified the people on the list to get a backup generator as they were dropping the program. I put in a dual fuel (natural gas or LPG) 17KW alternator with an automatic transfer switch. It's big enough to carry all the 120 volt circuits and the 220 deep well pump. I left the other 220 stuff off the list as when the SHTF you don't need AC or clothes dryer.

We haven't had an outage since I bought it (they used to occur semi-weekly).

Highmark Blue Cross/Blue Shield has been hounding me off and on for the last few years along the same lines. Last time one of their reps called, I told him that I had already declined this “service” several times and that if I'm contacted again about it, I will take legal action on grounds of harassment. I also told him that I know Highmark is trying to gather this information for the feds and that he can tell them if they want to know about my health, they can subpoena my medical records.

The insurance companies, at the behest of the feds, are targeting seniors because they think we are a compliant bunch who will just go along with the program. Eventually, they will come up with a way to con the younger generation into compliance. As long as the feds don't have legal authority (court order or subpoena) to obtain this information, your father is under no obligation to comply.

Me too. Had no idea how bad my life was before one. Stopped dreaming for 20 years, woke up with heart racing four times a night, nodding off at work.

I have a two year old model that DOES track my use, and they read the chip once a year on checkup, but it is not wireless. That may have come along later.

Is it connected to the phone line or siting enabled so it can access your network and have you added it to the network? If not there is no way for it to communicate with the outside world. There is a very expensive model that records your breathing, interruptions and if it is removed. That’s used to develop the settings for your machine. The doctor IMO is trying to scare you into wearing it.

Make sure they give you the humidifier. When I got mine they didn’t prescribe one by mistake. My throat felt like I was in the Sahara Desert. There are lots of different masks. The first one I got was horrible. We tried a different one and it was much better. There is also a BIPAP version of the machine where the pressure changes depending on whether you are inhailing or exhailing. It helps if you swollow air using the CPAP.

The spouse has a job too. If the person removes the mask during the night then you’ll need to remind them to put it back on. If the snore it’s probably going to wake you up. If it doesn’t wake you up and you discover it in the morning you’ll need to deal with it then and figure out how to check during the night. If you pull it off in the middle of the night it continues to run for a minute or so unless you fur it off. The sound of the air rushing out of the mask is pretty loud.

I sleep better when I wear it but I bate it so I pull it off in the middle of the night. When I wake up I put it back on. I don’t want to from a comfort prospective, but the reason I am awake is I stopped breathing long enough to wake up.

I thought there were two types of apnea.... Congestive and a mental type where ya were pretty much like a fainting goat... ?

One your get sleepy, the other ya blackout ?

Me thinks the Doc was suggesting this chip / tracker tech to the mental type apnea vs the congestive. For the mental type apnea you can lose your license period. Had a coworker that ran into this problem.

Sad because two of his buddies have the congestive type of apnea or need for a CPAP and he has the other type of apnea that is also treated with a CPAP.....

Does that sound right.... Bad analogy of the fainting goat thang maybe....
