I'm presently looking to buy a WWII German Luger. Having just moved to the state of Illinois, I checked into the specific laws pertaining to the purchase and ownership of firearms.
Of the many Draconian gun laws in this state there is one that is particularly onerous....Obtaining a FOID(Firearm Owners Identification) card.
The law that the legislature passed states that the card must be either issued or declined within 30 days of receipt of application. The FOID sight states within 30 days of your application fee of $10.00 being cashed. An immportant distinction being that it took them 2 weeks to cash my check.
Well it's been two months post check clearing and still nothing. They have an inquiry line to call but there is a recording that all service personel are busy and to call back. I've called a couple dozen times over several days and never any answer. They also provide an E-mail to enquire on your app which I sent over a week ago with no answer. After doing some research it appears that many others have also experienced this problem.
The ISP Firearms Enforcement Division is operating in direct violation of the laws it is pledged to uphold and enforce. I'm surprised the NRA hasn't filed suit as this is an egregious breach of the public trust and a blatant violation of the Second ammendment.
I don't know if these are intentional delays or just incompetence by the state. Either way it's against the law and needs to be addressed.
I recall that there may be an avenue that Archy knows to pursue this case.
- There is federal deprivation of rights, but there might also be something particular to Illinois.
Next step is to try and find an attorney who will help you there are most likely some that specialize in firearms law there.
Or they are feet dragging waiting to see what the law changes are going to be with regards to CCW.
Hmmmm, the mod removed his comment. What did he say?
Many reasons I needed to move here but after living in Georgia it seems like living in the Soviet Union.
Hmmm... I see your first mistake.
When up go to apply online or a FOID card, it says that due to high demand, your approval may be delayed.
Apparently that’s a disclaimer to cover any law. Mine took 3 months to come. My sons took 2 months & it was a renewal.
“Apparently thats a disclaimer to cover any law.”
Correct me if I’m wrong but I’m not aware that a simple “disclaimer” can supercede the law as written.
Relax.
Mine took 7 weeks this year. My gun shop says they’re running up to 12 weeks now for new FOID applications due to the massive number of new applications.
Don’t spend money on lawyer. It’ll come. I’ve never heard of anyone who wasn’t a felon getting one.
Chicago may be a Commie city but the rest of IL is not. The IL State Police support gun rights for the most part.
Shhhh... I don't think you're allowed to say that in Illinois.
Profanity.
My Wisconsin CC permit arrived two weeks after mailing in the application.
“Chicago may be a Commie city but the rest of IL is not.”
Lest you forget Champaign, Moline, Joliet, Peoria, Carbondale, and East St. Louis.
Well I’m not aware of any disclaimer either, but that’s what their website states.
North Chicago and Waukegan are in pretty rough shape as well.
Before you expect the NRA to sue, understand that there is a need for standing. Sounds like you have standing, so why don’t you spearhead the effort and file a suit yourself? You may even gather enough attention that the NRA might assist or back you.
“so why dont you spearhead the effort and file a suit yourself?”
Cost. Generally the NRA obtains standing by gathering a group of affected individuals like myself and rolls them into a class action suit.
I have informed them of the situation.
Come to Washington state - no FOID nonsense. My CWP renewal took fifteen minutes at the sheriff’s station. Background checked and printed right there.
