“Given that you believe that a tyrannical government must authorize any martial activity of the Militia”

I did not say that.

You are suggesting that your town government is tyrannical. That your county government is tyrannical. That your state government is tyrannical.

We have a duty to use lawful processes, and before war, to exhaust lawful processes.

I wrote about the lawful process for the militia to exercise martial power.

I wrote to encourage men, and women, to consider petitioning their representatives, in any of local, county, and state goverment, to Call the Muster.

I *know* from experience, that people need to associate for the purpose of our common defense.

Yet, it must be lawful, and for the most part, we must consider, What would General Washington expect of us?

He would expect discipline. He would expect that there was no activity except as authorized by a lawful body of representatives - in his time, they were the Continental Congress, and in our time, they are any of the representative bodies about which I wrote: local, county, and/or state.

The need of the people for their common defense, must be so great, as to compel them to get their representatives to make the call. After that, if the urgency be great, then to authorize the exercise of martial power.

If one of these governments is un-just and tyrannical, then we have a duty to relocate ourselves to another jurisdiction, where its local, county, and/or state has seen the trouble and is not weak in the knees.

It is a basic and necessary principle of law, that martial power is answerable to civil authority, in our country. Nobody who has the power to enforce law by means of force, has “job security” - they can be removed without even giving a reason, by a government executive or by the body of representatives if the government executive is weak in the knees.

We can organize and drill, train, and become quite professionally prepared to act ... but we must get authority to act from the representative body of government, so that we remain in adherence with the wishes of the people who elected them.

So, if New York is a police state, and the people cannot get relief from even their local town, after not getting hellp from the county or state ... they have a duty to first try and get to another location where government is responding to the wishes of the people.

Where governments are not responding to the wishes of the people, then the people must do what our Founding Fathers did:

Build a new ship of state.

Just as they *first* created the Continental Congress as a new ship of state, to which we moved allegiance from the Crown, *before* hostilities, then we must also.

Personally, I believe the time has come for 2 representatives elected by members of the Tea Party in each state, should assemble as a body to take into consideration, the documents, both Declaration and Constitution, that we ought to begin work on, for a new country that is really just the restoration of the old, but with a few, and I hope just a few, refinements all about limiting the power of government, bankers, and lawyers, which history has proven to be necessary to preserve liberty *from* those three special interests.

Obviously, the courts need to be bound to more narrow interpretation of the law, and the U.S. Supreme Court must be prohibited from amending the Constitution - the amending process was laid out, but usurped by the Court.

Obviously, banks and bank officers should have been banned from making any kind of political donation to government agents, agencies, officials, and court members.

Obviously, the Bill of Rights needed a warning label: We mean what we say, about “not infringing,” and other words that leave power in the hands of the people and the states AND NOT IN the hands of the federal government.

So, there is a lot of work to be done, building a new ship of state, but we are going to need it.

Our opponents need to be faced with its presence, as the British discovered on the horizon, here came a new ship capable of resisting tyranny.
