In Washington this week, a rare drama is unfolding in the U.S. Supreme Court. The momentous question that is before the court is this: Shall we be Citizens or Subjects?

The high court is considering a historic challenge by twenty-six states to the Affordable Care Act, otherwise known as ObamaCare. Hundreds of people have stood in line, some of them overnight in the chill March air, to get inside. Our colleague, Ken Klukowski, was one of those fortunate few. We are relying on Ken’s reporting and also on the impressions of Virginia Attorney General Ken Cuccinelli.

Ken Klukowski reports what was perhaps the critical exchange in the three-day oral arguments. Justice Anthony Kennedy is widely viewed as the pivotal figure in this case.

Hmmm, could’ve fooled me. After listening to Rush and Mark's shows from today, they appear to be implying that this hasn't hurt Obama at all. In fact, according to Rush, Obama’s getting what he wants here.

It never fails; if there's something that appears to be positive for us, Rush dutifully reminds us that it will benefit Obama. I find myself completely depressed as of late listening to both Mark and Rush. It doesn't matter what happens, it will ALWAYS benefit Obama.

Heck Rush was also kind enough to tell us how the Court finding ObamaCare unconstitutional will actually have negative consequences. How utterly demoralizing.

This guy is right. Are we citizens or subjects? I hope the SC takes note of that. We are a free people not slaves.

I agree with you completely. But until guys like Rush and Levin start advocating for political organizing of the core conservative demographic, their utterly ineffective and depressing radio programs will just continue to be utterly ineffective and depressing.

I heard the complete opposite from both. They both picked apart Obama’s reaction to the court. In particular Rush laid out how obama will react and try to rile up his base. He is not saying it works...he’s just predicting behavior.

It sounded to me like Rush was predicting that Obama would successfully use both the rejection of Obamacare by the Supreme Court to get his base to vote the Demos back in again to pass a new Obamacare law that would pass constitutional muster, and he would use the weak recovery against the wall-streeters and keep his base turning out in large numbers for him. It just might work, and Rush sounded like he thought it would too.
