In the People’s Republic of Massachusetts you’re criminally liable for the use of deadly force against an intruder unless you can demonstrate that you were unable to flee — from your own home — instead. No Castle Doctrine here!
I don’t know, this seems overblown to me. Apparently all she did was clarify when it was legal to shoot, and was told the intruder had to enter the home.
(Of course, if she was a cop and someone was breaking into her home she could blow him away because she could legally fear for her safety. But since she was a civilian, the intruder had to actually break in and be within killing distance in her own home before the government would finally accept that she was in danger.)
At least she can use the 911 tape in her defense, criminally and civilly, since she did finally kill the perp - once he was allowed to get close enough to kill her, per police instructions.
Good thing she didn’t have a dog - when the cops showed up to investigate the shooting, they would have killed it.
