If there is nothing to this why would they sue? Are they that crazy or is it a publicity stunt?
You are making the assumption they are actually suing versus talking out of their a**** like they have about everything else? Why would they sue Fox when, in December, they claimed CIA spies where preventing the tape from being played? They have been making up the story as they go.
