Mexican trucks to enter U.S. freely?

A U.S. government agency has begun a new audit to determine if the Bush administration has resolved inspection issues that would allow Mexican trucks to enter the U.S. freely...Since before the passage of NAFTA, a decision to allow Mexican trucks into the U.S. on a non-restricted basis has been hotly contested.

On June 7, 2004, the U.S. Supreme Court reached a unanimous decision in Department of Transportation v. Public Citizen, ruling that Mexican trucks under NAFTA could enter the U.S. freely, even if the Mexican trucks failed to meet environmental standards as set by state and federal law.

The decision effectively lifted a 1982 U.S. decision to ban Mexican trucks from U.S. roads, except for a 20-mile zone near the border. The ban had been kept in place by the Clinton administration, despite the passage of NAFTA in 1994, with provisions specifying that the Mexican truck moratorium would be lifted.

Still, thousands of Mexican trucks have not started rolling across the border yet. Why not?

The answer lies with the Federal Motor Carrier Safety Administration in the Department of Transportation. According to Section 350 of the Fiscal Year 2002 DOT appropriations act, the FMCSA must first certify that Mexican trucks applying for cross-border entry into the U.S. are safe for long-haul operations.

"With all the obstacles that still need to be overcome, our government must heed the OIG's warnings from the January 2005 audit," Galen Munroe, a spokesperson for the Teamsters Union told WND in an email. "The motor carriers in Mexico need to adhere to the same regulations and standards that our companies and drivers are subject to. Unfortunately, this seems to be a near impossible task with Mexico's current infrastructure."

The safety hazards being scrutinized by the FMCSA are in addition to ongoing environmental concerns. Commenting on the 2004 Supreme Court decision in Department of Transportation v. Public Citizen, legal analyst Noah Sachs noted the adverse consequences likely to follow this decision:

As a result of the ruling, thirty thousand or more Mexican trucks – which are generally older, more polluting, and less safe than their U.S. counterparts – will be allowed to conduct long haul trucking operations to locations across the United States. Recent government studies estimate that eighty to ninety percent of the Mexican truck fleet was manufactured before 1994.

In a preliminary environmental review, FMCSA concluded that their emissions "can be expected to translate into incremental increases in premature deaths" and "an enhanced incidence of respiratory diseases" in the United States. A 2002 U.S. EPA study reported a "persuasive" link between inhalation of diesel exhaust and cancer...

No, no, that's what 'free' trade ala NAFTA and GATT is all about, taking Americans and lowering their standards all the way to the environmental, labor, and legal standards of the Third World. We're just being fair to the poor countries who can't afford to send their slave-labor-assembled products in trucks with brakes, or insurance, or experienced drivers, donchaknow?

Already happened! A few of years ago, an 18 wheeler came through Corrigan Tx over 70mph with no brakes. Killed a woman in the intersection that just dropped her child at school , and went into an Exxon station mowing down the gas pumps. Caught the whole intersection on fire and destroyed the station. Mexican driver with no insurance. He lived. Don't know the final outcome.

If you look back to when the Teamsters were whining about different requirements for American drivers vs Mexican drivers, that's when it happened. It was in the news then. The Teamsters were moaning about NAFTA for this very reason. Their drivers and trucks didn't meet our road standards, but that's OK. If a Mexican truck had to have an inspection sticker and a driver had to have insurance, then where's the advantage in hiring a Mexican truck?

Massive illegal immigration from Mexico started when NAFTA was passed. Both are designed to integrate the USA with that corrupt sh!thole to our south. Mexican manufactured goods flowed here with NAFTA and the illegal alien hordes followed in their wake

They need to ammend the law too.

Let US citizens set up and run truck maintenance shops just outside the border. Charge the Mexiscam trucks that want to run 20 miles plus past the border a minimum $1500 / year base plate fee and buy US insurance just like US carriers.

Let the Mexiscam trucks be inspected (just like US trucks) every 30 days as they enter into the US. If safety violations are found, the Mexiscam trucks have to turn around and go back into Mexico for repairs or pay for US citizen owned repair services on US soil. If they return with the same safety infraction(s), then $500 fine per infraction. If found trying to enter again a third time with the same infraction(s), uncorrected, the truck and its cargo are impounded.

I say, let the Mexiscam trucks feel the pinch of of operating at $2.04/mile like the US truckers. They may just decide to stay in Mexico.

Almost forgot, the Mexiscam truckers must possess a valid US CDL too and have documented class time in the US (30 hrs) to cover all rules of the road as US truckers....US logs, etc., the whole 9 yards.

If they want to compete, let them play by the same rules. BTW, if more than 1 log-hours (10 hr driving per day max) infraction per 30 days period, US driving privileges are suspended for 1 year.

I think the above is a good starting point.
