IMO, anyone who is illegal and caught in a crime should not get “bail” - they should be immediately put on a plane and all their assets seized.
They deserve the “Marcellos treatment”.
For those who don’t know the history Carlos Marcello, Mafia Mob boss of New Orleans at the time, was kidnapped by Bobby Kennedy’s Justice Department, placed on an airplane and then dumped into the Guatemalan jungle.
The rest of the story:
Carlos managed to walk back into civilization, sneak back into the US and was caught on a FBI wiretap saying “get that stone out of my shoe”.
Many believe the “stone” was JFK and Bobby—and that this was part of the plot that led to the assassination.
You need to rethink that. You would be giving them an automatic 'Get out of Jail Free' card based on their illegal status.
I agree that an alien who is subject to removal should never be granted bail because their is no way to ensure their further court appearances. This is the essence of Likely to Abscond. It a sure thing if the government deports them.
It further mucks up the works because the alien now has a legitimate excuse for not showing up for hearings. "Hey I wanted to appear and clear my good name, but the fed/ government deported me."
Then to add insult to injury, they can get their bail money back.
No we need to hold them without bail, have a trail and then deport them after they have served their sentence.
“All their assets seized”.
In the case of illegals, life is an asset.
