Iowa Passes Right to Keep and Bear Arms Amendment 65% to 35%

Iowa was one of only six states without a provision in the state constitution to offer protection of the right to keep and bear arms.

In the last part of a long, complicated process to amend the Iowa State Constitution, Iowa voters approved of Iowa Amendment 1, Right to Keep and Bear Arms (2022) by nearly a 2-1 margin.  From ballotpedia:

With 98.55% of the vote counted, the election result makes clear the Right to Keep, and Bear Arms has passed.

From the desmoinesregister.com:

The percentage of victory for the amendment is several percentage points higher than was predicted in a poll done a few days before the election. In that poll, 58% of Iowa likely voters planned to vote for the amendment,  37% planned to vote against the amendment, and 6% were unsure.

When the votes were counted, all those predicted by the poll voted for the amendment, including all those who were undecided and about two percent of those who said they would vote against it.

Iowa continues the trend of large percentages of state voters approving of constitutional amendments protecting the right to keep and bear arms. The actual wording of the Iowa amendment is this:

It was put into the Federal Constitution to ensure that future states would be covered.

Before the Federal Constitution was put into effect, each State was ordered to draw up their own Constitution. See the Avalon Project.

They are and always have been protected under the Federal Constitution.

Many people thought so.

But, in 1833, the Supreme Court ruled the "Takings clause", of the Fifth Amendment, did not apply to the States.

After that, all the Amendments in the Bill of Rights were considered not to apply to the States.

Some of the states that infringe most on the rights protected by the Second Amendment have no protection in their state constitutions.

The states without such an amendment are:

California, Maryland, Minnesota, New Jersey, and New York.

How can a “right” be added to a constitution? You either have the right or you don’t. A constitution is designed to enumerate what a duly elected government can and cannot do with regard to God given rights.

How can a “right” be added to a constitution? You either have the right or you don’t. A constitution is designed to enumerate what a duly elected government can and cannot do with regard to God given rights.

The amendment is designed to protect the right, not add it.

The whole purpose of government, in the American scheme of government, is to protect existing rights, and provide for the administration to do so.

You have a right to life.

Government provides numerous services to help you keep that right to life, and not have it taken away by invasion or criminal assault.

The amendment is designed to protect the right, not add it.

I read the ballot. The word "adding" there is pretty clear.

A “yes” vote supported adding a right to own and bear firearms to the Iowa Constitution and require strict scrutiny for any alleged violations of the right brought before a court.

Could have been better worded, to be sure.

It should have been "adding a right to own and bear arms amendment".

Here is the actual amendment:

Right to keep and bear arms. Sec. 1A. The right of the people to keep and bear arms shall not be infringed. The sovereign state of Iowa affirms and recognizes this right to be a fundamental individual right. Any and all restrictions of this right shall be subject to strict scrutiny.

Notice, it doesn't even mention firearms.

It is all about saying the right shall not be infringed, not adding a right, and that the state of Iowa affirms and recognizes the right, it does not create the right.

I forget if it is the Secretary of State who wrote the description, or someone else.

So the Dems and their media are now claiming victory using the ...we fought off the wave and di good hypnosis. Well, they lost the House, very well may lose the Senate. Turned FL bright Red. Lost House seats in NY of all places.

Don’t get fooled, the GOP won big, will stop the disastrous Biden regime, and will gain more Senate seats in 2024 when more Dems are up.

The 2024 GOP process has begun, and let’s let it play out.

Yes, all about managing the expectations.

Demoralize the MAGA base.

Demonize President Trump.

The biggest triumph is stopping the Leftist agenda to turn the USA into Venezuela.

That has happened.

What we need to do is keep pushing.

In South Carolina by Law, every adult over 18 is a member of the State militia. They have been encouraged to own guns.
