It’s just a matter of semantics, but I would say present day America is closer to a totalitarian dictatorship along the lines of the Soviet Union.

We may have to go some now to even rise back to a banana republic level.
What we have is not simply a two-tiered justice system, it is a multi-layered INjustice system, There is no equality before the law, if the law is routinely ignored, and the whim of a rogue magistrate has come to be relied upon.
While not exactly anarchy just yet, a very large tinder box is just waiting to be ignited, and it will be no mere dumpster fire.
