These two were part of a 10 man foreign volunteer squad called "team baguette", part of the large foreign legion attached to the Ukraine military.
They are volunteers who previously worked for the US military, but are not active duty anymore. They were captured in the Kharkov area, having bad intel that Russians weren't where they were going. (Click link for video)

Then they are covered by the Geneva Conventions and they are not mercenaries.
If Putin has these men executed it’s a straight up war crime.
I have no idea why all the noise. There are more than 200 American mercs killed to date and nobody cares.
These guys are in DNR custody. They aren’t a signatory of Geneva Conventions and are free to define who the merc is and who isn’t.
Real or not, not our problem. They are Ukraine’s problem as they went there to fight on their behalf. Leave us out of this, their actions have consequences for them, let them deal with it.
When I say volunteer I’m just trying to say that they were not sent by the US military as active duty forces.
I’m trying to make clear that they signed up for this on their own, that they are not part of the US military now.
The way I was using this language would apply to Mercenaries also, they also volunteer to fight here. I don’t know how they should be classified, I don’t know how the law works on that definition. I know the Ukrainian separatists view them as mercenaries. I wish them well.

What war crime? Specifically please. I don’t think there is one involved with their capture. And if killed, executed, or whatever, is this a war crime and, again, if so, how so?

If the men are volunteers for the Ukrainian military then they’re covered by the Geneva Conventions.
If Putin has them executed then he can find himself dancing at the end of a rope.
That’s how this works.

You don’t know what they were. They may have volunteered, which was not too terribly bright. But if they were paid to fight they are mercenaries according to Webster, “one that serves merely for wages.”

I have a hunch there isn’t a single competency test of any sort that you could pass even minimum standards.

In any case, not our problem. If they chose to go to Ukraine and kill Russians, the consequences are on them. Unless you want to make them martyrs to justify further US involvement in Russian-Ukraine civil war.

The stolen yacht will go be regardless. What else do we ahve to trade, and should we? These are Ukrainian mercanaries or volunteers, their US citizenship should be voided and irrelevant while they are killing on behalf of the Ukraine.
Trade them for Julian Assange, who is not a criminal but being essentially executed by the FedGov.

They will be tried. They deserve the worst.
They aren't mercenaries, but UA soldiers who fought in UA uniforms and under UA command.
The only actual mercs fighting in Ukraine are Russia's Wagner group, plus whatever Syrians or Chechen soldiers not integrated into the Russian army.
