But why, he’s getting his butt kicked by Abbott. Maybe this is an attempt by the Deep State to raise West’s profile, since he couldn’t be doing any worse, and West would be FAR EASIER to beat than Abbott, whose basically indestructible at this point (despite FRs being iffy about him).
Nowadays in most states if you refuse the roadside field sobriety test it’s an automatic DWI and you lose your driver’s license for I think 30 days. Maybe 90.

Nope, not for a field sobriety test, that only holds true for the breathalyzer or blood test. If asked to perform some silly sobriety test, respectfully refuse and instead ask for a breathalyzer. There is no law that requires a physical test of abilities. As I said earlier, you could fail the physical field sobriety test and pass the breathalyzer or blood test and still be convicted. All the cop has to say is that in his opinion, your abilities were compromised.
That loss of discernment has cost LEOs more than they can ever imagine. Any support I may have had for them in passed decades has dissolved to ambivalence.

If they are testing to see how far they can push us it won’t be long. I’m on a hair trigger and I don’t like it but it is the fact. The reason is simple, things like this.
I actually have a huge fear of getting a DUI while not drinking. I have little bit of stumbly when I walk. I will get a blood test if it ever happens, but I am fairly certain you lose your license either way

They ask you to say the alphabet backwards because once you say I could not do that sober you just admitted you were drunk . They always say you have glassy eyes also and slurring your words . All text book stuff from the academy.
That’s why the standard advice has always been to refuse a “field sobriety” test. It is subjective, and therefore it is also possible to get a DUI even though there is no level of BAC impairment. Not worth the hassle and expense. If you’re drunk, it won’t matter. If you’re not, it can matter a great deal as your friend found out!
It IS a requirement that drivers submit to a blood test or similar, aka “implied consent”, but a “field sobriety” is not the same thing.
