The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

Having every state pass their own Constitutional Amendment to kick Sleepy Creepy Joe out of office ain’t the way the Constitution was designed to be utilized. There are two ways a Constitutional Amendment can be added to the Constitution. The first of which has been bantered about on Free Republic and that is a Constitutional Convention. The second and most utilized way is that Congress passes a bill in both the House and Senate, the bills must be word for word exact. There is no reconciliation process for a bill of Amendment. The bill once passed in Congress must then go to each state to be ratified. It takes 3/5ths (I believe) of all the states (right now 50 but if a state or two would be added then it still takes thre-fifths). Once ratified by the 3/5ths the Amendment becomes a part of the Constitution.

If each state were to come up with their own bill for a Constitutional Amendment, it would be a nightmare. As each bill must be introduced into each chamber and voted on. Then that bill would then be taken to each state to be ratified. This would happen for each state in the Union. Not good. Its why this idea doesn’t pan out. The Foounding Fathers had it right. Let them do their job.

The other way is the 25th Amendment to oust Sleepy Creepy Joe. And you thought the 25th Amendment Council or whatever Pehosi wanted was for Trump. No it was to make it easier to remove Biden. I saw that one coming qa mile away and it made even more sense after Sleepy Creepy Joe won the nomination and the other candidates dropped out suddenly. It was at that time Pehosi was making her rounds with the idea for the 25th Amendment Council.

A sound point. However, there's a first time for everything . . . And, we're kind of in uncharted territory, so I wouldn't put any bets on the outcome being what any of us have ever previously known.

There aren’t quite enough Republican Legislatures though, 31. Needs 34 to propose it and 38 to pass it.
