Mr. Dershowitz is mistaken. They can impeach him, and very quickly. That could happen in only a few days. The Senate, however, may choose to delay action on the impeachment until after the inauguration. At that point the trial is completely moot and would not be held. If the Senate does not delay action until after the inauguration the Dems need a 2/3 majority to convict. I doubt they can get that. If they did get that then President Trump is toast. He should put in a dead man switch that is activated upon his removal from office - release a vast amount of dirt on the Dems and the Republicans that voted to convict.

They would want to do it just to smear him and have it be a stain on his record.

Pelosi has the time and votes to achieve impeachment now. When the impeachment document is transmitted to the Senate is under her control.

Wouldn't put it past her and Schumer to table until 2024 to threaten the Trump campaign with second impeachment trial if he were to win the election.

Kind of insurance again.

The limit is that you can only impeach elected or Senate approved appointees. Trump will not be either in 10 days.

TwitterNazis have been demanding Clarence thomas’ impeachment for two days now, #1 topic, because Ginni Thomas tweeted “Love MAGA” at a pic of the pre-”storming” rally.

That and ex-post-facto laws, prohibited.

(A bill of attainder, or corruption of blood, has to do with punishing a person's descendants for a capital crime they did not commit. It's prohibited in the Constitution, although it was still practiced in England until the mid-19th Century.)

I don't think that can work, Pea. Congress cannot even carry legislation over from one session to another, they have to reintroduce it.

“There are no timing limitations on the use of the Impeachment process in the Constitution. So there is no limit in the Constitution for impeaching someone after they have left office.”

I think you might be mistaken. The Constitution grants the House of Representatives the power to impeach “the President Vice President, and all federal civil officers...” After January 20 at noon it looks like someone else (spit) will be the President...

RE: You Can’t Impeach a Private Citizen After He Leaves Office

The purpose of impeachment is to remove Trump and prevent him from EVER taking public office of any kind again.

QUESTION: Can an impeached President ever be elected for public office of any kind?

SECOND QUESTION: Can Congress, After Trump leaves office, pass a law specifically saying “Donald Trump is Hereby Banned from any public office in the future”?

Impeachment is an exception to the rule that “the matter dies.”

https://www.riddick.gpo.gov/UserData/SenateProcedures/Impeachment.pdf

11th page of that PDF, page 975 of Riddick’s Senate Procedure.

I don’t believe that we’re so divided....the Left wants us to think were divided.... They want to foment division..... Most Americans get along with each other just fine in their communities with differing political opinions

People have no interest in taking up arms against each other in order to fight over issues like climate change, transgender rights, and white privilege.... Yes, there are lots of people who will nod their heads in agreement to this nonsense, in order to not make waves.... that doesn’t mean that they’re passionate about it

I live in New York City and pretty much everybody on the street is wearing masks.... I refuse to wear a mask in the Subway, and for the most part, nobody ever says a word to me.... if we were really so divided, I would have been beaten to a pulp repeatedly by now, in such a Left wing city

Please, that wasn’t my comment. That comment was in italics, which means that it’s somebody else’s. I then responded to it pretty much saying what you just said.

Parsing the constitution will not resolve the outcome. Plain words can be twisted to mean the opposite of what they say. Courts and Congress are professionals at this.

Somewhat true. I can be civil around people that I disagree. However, that has changed.

I do not care what the reasons are. Ignorance, indoctrination, low IQ, or if they are just plain leftists. They support or active work towards the elimination of my rights. Sure, I can get along face to face, even be friendly. But they are the enemy now. I want them gone or my full rights restored, beginning with my right to vote in a fair and legal election. Until that happens I have no representation. Our founding fathers thought that was reason enough to revolt and kill the enemy. I agree the founders, even when the enemy is friendly face-to-face, but through other means wants to continue to eliminate my freedoms.

1) removal from office is not the only possible punishment
2) Impeachment proceedings can be applied to any officer of the US
3) It would also look very stupid to rig an election by blatantly adding thousands of votes. But here we are.

When the Constitution is relegated to a recommendation and is not the supreme law of the land, anything goes.
