It was only the third degree murder charge that was dismissed, That’s the lowest homicide charge. Still facing the remainder.

He could not be charged with both second degree murder and third degree murder for the same incident, so one had to be dismissed.

I am not a lawyer but isn’t a second degree murder charge harder to prove than a third degree murder charge? If so, could it be advantageous to the defense to have this one remain?
