In this case, yes. In emergency situations, each Justice handles issues from a specified part of the country. PA must be his. Kagan handled one singularly last week....from Utah or somewhere.

It was a 4 - 4 tied Vote so it refers back to the Lower Court Ruling.
That is why we need Barrett on the Court ASAP.
