I just finished reading the amendment. It gave me a headache. But yeah, the provisions of the amendment are triggered by the cabinet members, and not by Congress.

So Pelosi has no business sticking her nose into the matter. None at all.

This is the best piece of incontrovertible evidence yet that libs have no sense of irony—Pelosi calling someone else ”unfit” for office.

I am so glad things are getting back to normal.

Yes, it does. Congress can do what Nan is attempting. Of course it would also have to pass the Senate and be signed by the President. So this is being done just for show.

I’m sure that Nancy is doing this only after a great deal of prayer. /s

Actually it does but in this context, what is being done is irrelevant.

25th Amendment Section 4 (reads in part)

....or of such other body as Congress may by law provide,...

So Pelosi would have to submit a law, get the house to pass it, then get it through the Senate and then for the Presidential veto and back for a veto override BEFORE her little commission has any authority to do anything.

Not necessarily true. Section 4 states that the VP and a majority of the principal officers in charge of executive departments or such body as Congress may by law provide...

Of course it’s the VP AND such other body that Congress provides by law, meaning Pence would have to go along, both the House and Senate would have to pass a bill to designate a body, and Trump would have to sign the bill (or both houses vote by 2/3 majority to override a veto). Not likely, but Congress can play a role in the 25A process.

Uh actually it does.
“Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.”

However they need 2/3rds of both houses, and so it’s DOA.
