I we were to look at this as an isolated instance, of a disgruntled employee leaking confidential documents of one of the political parties, to a known hostile intelligence gatherer, it is most definitely a legitimate case of espionage.

And it wouldn’t matter at all what the content was in the leaked documents.

So the big problem is how the counter-intelligence process worked. That is, under what circumstances can an intelligence agency sanction a leak? What is the process? Who is authorized to order his death, as well as hiding the circumstances of the leak?

Assuming that Seth Rich was an American citizen, and he was murdered on American soil, everyone involved in a scheme to murder this, including the one who committed the act, would be guilty of murder, as well as conspiracy to commit the murder, no matter what "crime" Seth Rich was alleged to commit. The action is no different than a mob boss ordering a hit.
