California has overreached in its effort to address the challenges in todays tech platform gig-work economy.
The live music sector, the progenitor of the term gig work, is being swept up by this law. The irony would be comical if it were not such a serious problem.
There are some worthy arguments to be made for Assembly Bill 5 by Assemblywoman Lorena Gonzalez, San Diego Democrat.
It could improve the lot of workers trying to piece together a living in this expensive state. It should help capture unemployment taxes from unscrupulous employers misclassifying workers as independent contractors.
However, the law has created a tangle of red-tape and administrative expense for large portions of Californias cultural sector.
To illustrate: In 2019, San Jose Jazz presented more than 1,000 musicians across 326 different performances. The vast majority were independent musicians and singers from California, the nation, and around the world.

I am so surprised that the likes of Uber and Lyft have not convinced some judge to slap a TRO on this stupid, union-payoff law.
But it was cool and funny when it was happening to other businesses, right? F these guys.
If the musicians are suffering then maybe they should change from Jazz to the Blues.
Nobody knows my troubles with HR.
So the corrupt California Dims will make some more exemptions to the law until only those in a few powerless industries must continue to abide by it.
I’ve been in over a dozen bands. This whole thing is a perfect example of why governments need to stop meddling in anything that is not a “dire” need. They only make it worse.
If this was the world I started playing in, I wouldn’t be. My bands all just went to the venue, agreed on a price, they paid the band and we split the money. Each of us then took care of our own taxes. And we all had day jobs. Most musicians have day jobs.
I’ve said for decades that being in a band today was like being in a softball team in the late 20th century, except you make enough money to keep you in gear and maybe pay for your gas. i.e. we did it for fun.
This completely destroys that. This is gonna hurt California’s music scene big time. Just add it to the list of reasons I don’t live in that country. My country, Kentucky, allows its citizens to enjoy much more individual freedoms.
Its currently being fast tracked in New Jersey.

This law just may kill virtually all live music in California, with the exception of those that are fine with working deals under the table - which happens a lot anyway. It’s the “formal” events that may be done for.
Are the members of ‘performing arts’ mainly left-leaning? If yes, they do not have my sympathy. Change your vote and I will certainly try to give a damn.

Some workers would rather keep ALL their money than pay into FAT CAT fake govt insurance.

I've read or heard on TV that they have filed a lawsuit. This is going to greatly impact independent owner/operator truckers, which of course raise prices on everything.
This is how communism begins - government control of goods and services first, then gov. ownership of the entities that provide such. There is no longer any doubt that Kalifornia is past socialism and looking towards full on communism. What's sad is the millenials are buying into it with Sanders/Warren promises of free everything, with no obligation to earn any of those freebies.
I just heard on Laura last night that Bernie was kicked out of a commune back when. Reason: He didn't fulfill his work duties as assigned, but still wanted his equal share of the distribution. That is exactly why the communes of 1960's failed and disbanded. I know because I had personal experience with commune members back then.
One of my friends has 3 businesses, two where he provides contract services and one where he employs people one a contract basis. All three lines of business will fail under this law because no one needs his services full time nor does he want to work for someone else full time, and the business he hires people for is somewhat seasonal and isnt big enough to support regular employees year round. Not certain of his voting pattern but he seems to dislike Republicans more than Democrats so he is probably getting the government he voted for or at least didnt vote against. He is certainly ranting now on Facebook to everyone that will listen.
This stupid law is a small business killer and will prevent some critical seasonal services from being done. That is a bigger problem than some musicians who cant play nearby.
