Before you start counting your flying pigs, you might want to wait for the inevitable en banc appeal to Ninth Circus which are guaranteed to overturn this three judge panel's decision.
Exactly it was just a lucky draw for the 3 judge ruling. The full circus wil “fix” this no doubt.
This is just a preliminary ruling denying an injunction while the lawsuits challenging the regulations are resolved in due course. I’m not sure even the 9th would want to devote an en banc to a procedural issue.
