Citing a violation of First Amendment and Fifth Amendment rights, cable news outlet CNN has filed a lawsuit against the Trump administration, seeking the permanent return of Jim s press credentials.
CNN is claiming that while it happened to Acosta, it could have happened to anyone.
CNN Post : "CNN filed a lawsuit against the Trump Administration this morning in DC District Court. It demands the return of the White House credentials of CNNs Chief White House correspondent, Jim Acosta. The wrongful revocation of these credentials violates CNN and Acostas First Amendment rights of freedom of the press, and their Fifth Amendment rights to due process. We have asked this court for an immediate restraining order requiring the pass be returned to Jim, and will seek permanent relief as part of this process. While the suit is specific to CNN and Acosta, this could have happened to anyone. If left unchallenged, the actions of the White House would create a dangerous chilling effect for any journalist who covers our elected officials."
CNN Tweet :"CNN Communications✔@CNNPR This morning, CNN filed a lawsuit against @realDonaldTrump and top aides. The White House has violated CNN and @Acosta's First Amendment rights of freedom of the press and Fifth Amendment rights to due process. I really disagree with the claims.
Well several reporters have taken to open hostility with this administration (rightly or wrongly, depending on your point of view), the fact is that Acosta was the biggest, loudest, and most obnoxious voice in the room, often to the point of distraction.
There is nothing in the First Amendment that guarantees the right to a hard pass from the White House to a reporter, and there is nothing from the White House indicating (so far) that they wouldnt allow another CNN reporter in. Likewise, Acosta is not being charged with a crime, so I dont exactly see how this is a Fifth Amendment issue. The press pass is not his property, it is a privilege granted by the White House.
The whole issue is stupid. Acosta has done more harm to press pool journalism than he ever did good. You can debate the value of a White House press pool for days, but its very hard to argue that hes doing anyone other than himself any favors when he openly combats the President, Press Secretary, and other White House officials.
How many journalists have missed an opportunity to question the White House because Acosta has refused to give up the spotlight? How many times must we endure his holier-than-thou approach to White House journalism? How many news cycles become about him and Trumps war with the press instead of the actual news of the day?
Lest we forget, the day Acosta lost his press credentials was the day Jeff Sessions was forced to resign. Which issue are we still talking about right now?
This latest stunt by CNN only further fuels Trumps base against them, and makes it so much harder to take them seriously in the Trump era.
Acosta attacked a intern, He is out.
This is Bullsh^t!
The White House briefings are a privilege, not a right under the Constitution.
.
Good luck with that... If I were an employee who’s job was in jeopardy because of possible cuts and what not, I’d be pissed to know they are wasting money on something that they have no chance in hell of winning.
Ignorant, rude and pathetic behavior isn’t tolerated at your local restaurant or bar, why should it be tolerated by Trump?
This is actually kinda comical. Someone told me that CNN can’t lose because this is just like a restaurant refusing service to someone. I pointed out that if the person is causing a ruckus and rudely treating the owner the owner has every right to kick them out.
Duh. Nobody is forced to allow someone else to cause a scene in an area under their control. And this was in an area under the president’s control.
Please correct me if I am wrong but wasn’t FOXNEWS not let in for YEARS under OBAMA?
Didn’t he smile publically then secretly order Brenner and others to illegally spy on journalists and lawmakers?
Am I misremembering this or does everyone have amnesia?
Too bad the courts don’t have jurisdiction. Separation of powers. The Whitehouse can issue or jerk press passes at its leisure.
It’s a privilege not a right; just like security clearances. Both can be revoked and lost.
What happened to “You have to believe the woman”. We even have this assault on film. Legally an unwanted touch is assault and battery. Why hasn’t Acosta been arrested?
“Shouting fire in a crowded theater” is not free speech!
Acosta should have been booted the day he was heckling POTUS Trump while Trump was interacting with young children at Easter. That should have been a permanent ban right then, or many other times, too.
Acosta is a total POS. I can’t imagine any legal basis on which a court should inject itself into this kind of matter, but ofc many of our judges are leftist turds.
The WH should fight this all the way to the Supreme Court if necessary. No way should journalists or judges decide who gets a Secret Service “hard pass” access to the White House.
The part about press passes is in there, you just have to look really, really hard.
“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
The White House is not denying CNN’s right to free speech, nor are they even denying CNN access to the daily briefings....just not Acosta.
Legally an unwanted touch is assault and battery....
Apparently you missed the fine print.
Footnote 1a.
* This law does not apply to news media, tv/movie stars, or registered/or dead Democrats.
Judge Nappy on Fox Business just said CNN had good case. The Judge is wrong.
Looking forward to the President taking away another press pass as warranted.
When is the Trump Administration going to move that gaggle of propagandists out of the Whitehouse and into another federal building?
I agree. If not mistaken, CNN is the credentialed agency, not Jim Acosta. His access flows from the credentials issued to CNN. So, he has no “right” to be there. CNN has, at their option the “right” to name another reporter to cover the beat. Therefore, there is no “harm” to CNN. Their ability to cover the White House is not exclusive to Jim Acosta’s ability to access the facility.
Frivolous lawsuit...make CNN pay all legal fees.
“Acosta attacked a intern, He is out.”
Yes. They are doubling down on stupid.
He should have apologized to her right away afterward, publicly and privately,
Pride goeth before a fall.
