“Wonder what the vegas odds are on them separating or divorcing”.

They’ve been separated for many years. They will probably never divorce for legal reasons. As a married couple they can’t be forced to testify against the other.

It depends on the jurisdiction. In some, the privilege still exists after divorce or death with respect to marital communications.

In addition, during marriage, some jurisdictions permit voluntary testimony. In other words, even though still married, some states would allow either spouse to voluntarily testify about marital communications even if the other spouse seeks to prevent it.
