That sure doesn't sound like he was down and defenseless. But it begs the question, do you stop shooting when the perp goes down even though he's still firing?

If he is still shooting, down or not, he is still a threat.
You shoot to STOP. If the perp has not stopped, you should keep shooing.
If he’s still shooting he’s NOT defenseless....

As a Texas state trooper once told me “if you have to fire, don’t stop till you’re out of ammo”.
If the fella I shot at was down and just twitching I’d probably let him be.
If he was still waving a weapon or shooting, I go for the “out of ammo” solution.
