Juan Manuel Montes, a Mexican national who is protected under the Obama-era Deferred Action for Childhood Arrivals act, is suing the Trump administration after being deported to Mexico in February.
According to the Los Angeles Times, Montes was deported to Mexico without explanation on February 17, despite the fact that his DACA status and work permit were valid. He was approached by Border Patrol agents in Calexico, California and prohibited from getting his wallet from a friends car so that he could prove his status, USA Today reports. Three hours later, he was deported to Mexico. If these claims are true, he would be the first DACA-protected undocmented immigrant to face the wrath of Trumps newly-energized deportation force.

Montes was taken to a Border Patrol station where, he alleges, he was made to sign documents and not allowed to see an immigration judge or attorney. He was also not given copies of the documents he signed, the lawsuit states. In the middle of the night, he was taken to Mexicali, Mexico.
Montess attorneys filed a Freedom of Information Act request in March for information on his deportation. The lawsuit filed in a California court on Tuesday is requesting that a judge force Customs and Border Patrol to release the information of their agents interaction with Montes. A statement from U.S. Customs and Border Protection says that Montes was arrested for illegally entering the U.S. by climbing over the fence in downtown Calexico. But the lawsuit alleges that the incident described by Border Patrol happened days after his initial deportation.
Out of all the horrible immigration reforms President Trump has made in his very short time in office, he has not touched the Obama-era DACA program, though its future could be uncertain under the new administration, like everything else.
The guy is a criminal. Shoplifter and 3 times driving illegally without a license. Not a good guy. Gets deported, climbs back over the fence into the USA and is caught, deported again. Screw him and others like him, deport them all.
Yep. They all need to go.
I’ve a simple question:
If he’s not a citizen, in fact an illegal alien who has already been deported out of the country, how does he have standing or any rights whatsoever to bring a lawsuit forward?
How do the rights of American citizens automatically get conferred to citizens of other non-american countries? Does that mean that now all other countries / nations are bound to abide by the laws and regulations of the USA?

The short answer is obama and his America killing EO’s and Anti-American policies in general.
He did a lot of damage; DACA should not have happened. I’m not heartless, I do feel for these young people who were brought here illegally as small children and are now teens and adults, but it isn’t our laws they should be mad at. It’s their parents who brought them here knowing they could not live here legally.
I choose to look at it like this. These kids, if they end up having to return to their home country, will go there with skills and an education they could not have gotten in their home country most likely. They have a huge leg up in getting something like a small business going in their country over someone who grew up there. Most of them speak Spanish fluently so that isn’t a problem. Some small minded people in their home countries might have some resentment of them because they do have a better education but if they keep their attitudes in check and don’t act like they are better than anyone else; they might win them over and be able to teach them some skills they otherwise wouldn’t get and just keep spreading what they know until they improve their own country and don’t feel a need to leave.
End DACA now.
Candidate Trump was correct when he said this was an illegal executive order.

Something is not right about this story.
If he is DACA and had a work permit they wouldn’t just take him and deport.

He wasn’t carrying any identification according to the articles on it.
In fact, with refugees who have not entered the US yet, they are entitled as well.
A terrible position, and it turns the Constitution on its head.
DACA requirement:
You must not have been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and must not pose a threat to national security or public safety.
If he’s been shoplifting, etc., I don’t think he qualifies anymore.
This guy couldn't even keep his nose clean enough to NOT break our laws FOUR times.
I challenge someone to try *that* in another country.
1. The estimate is 10-20 million undocumented/illegals are in the country now.
2. People don't get it. It is not the 10-20 million in the country we need to worry about.
3. Rather, it is the 10-20 million illegals who are waiting to cross the Mexican over the next ten years we also need to guard against.
And the 10-20 million who will try after that. And so on.
4. Imagine this happening. Tomorrow, Trump says that all those 10-20 million illegals in the country now will receive legal status and citizenship.
5. Do you really think that such Trump action will stop illegals from trying to cross the Mexican border starting the day Trump grants legal status? I don't think so. They will keep on coming. and coming.
6. Again, one main reason we need strict border control is not just to find the 10-20 million illegals already here. It is also to stop---over the next ten years--- those-—10-20 million illegals who are patiently waiting in Mexico and Central America this very minute to join the 10-20 million illegals already here.
7. Think about this: If Trump made the illegals citizens tonight, April 18, 2017, do you really believe that if you took a walk along the border tomorrow, it would be empty, that is, do you think that no will ever try to sneak across the border again, because they believe in Trump. Sorry. It won't happen.

Even Naturalized citizens can be stripped of citizenship and be deported.
You did not take seriously the risk of your status.
