At 1:55 a.m., on Monday, 28 November, at a 7-11 convenience store in Fresno, California, an armed and alert clerk fired one shot to stop an attempted armed robbery.
Two robbery suspects who burst into a California convenience store were left running for their lives after a store clerk turned the tables on them and fired back.I applaud the clerks rapid response. The entire incident took about eight seconds. With the advantage of plenty of time and screenshots from the surveillance video, you can see that the suspects were not armed with a rifle.
Surveillance footage from inside a 7-Eleven store in Fresno shows the moment a man brandishing a rifle, followed by a woman, went into the store and demanded money.
Was the item used by the suspect above real or fake? Hard to decide in a few adrenaline charged seconds.
- Brandishing a pistol, revolver, or other firearm capable of being concealed upon the person... in a rude, angry, or threatening manner... in a public place:
- a minimum three (3) month, to a maximum one (1) year, jail sentence, and/or
- a maximum $1,000 fine.92
- Brandishing any other firearm... or brandishing a firearm in other than a public place... in the same manner: not less than three (3) months in county jail.93
- Brandishing an imitation firearm: not less than 30 days in county jail.94

Might have been an air soft, but it looks more like a toy 75% replica with the orange tip off the end of the ‘barrel’.

The suspects seem to be awfully dark. Is there something wrong with the camera?
Fake gun news
Please know that in most States “brandishing” is entirely different than using a fake gun in a robbery. In my jurisdiction, this would indeed be “armed robbery” whether the gun was made of soap, an Air-Soft gun, an AR without a magazine or a round in the chamber, or a fully auto M-16.
The law does not expect the person being robbed to make an accurate analysis of whether the gun is real or not. If a ‘reasonable person’ could believe the gun is real, it is a felony armed robbery regardless.
Brandishing a firearm is akin displaying a firearm with the intent to intimidate.

Drug dealer shouldn’t have done what he did. But the LEO with back only about a minute away should have talked a little bit more.
A little BS goes a long ways in buying you some time before going hands on.
Sounds liked the dog really enjoys his work nothing like a good bite to reward a patrol dog.
