The question is not who filed but who had grounds to file.

True case, guy leaves his wife and two sons to drive across three state lines to have sex with a 13 year old that he met on-line. No surprise the 13 year old was a police officer. He is arrest and goes to jail. Turns out this was not the first time he had done this, just the first time he got caught.

The wife filed for divorce.

Who was not committed to the marriage her, for wanting filing or him for leaving her to have sex with a 13 year old?
