Based on that statute, I would have to agree. Most states require a public road for a vehicle code violation, because people are free to do what they want on their own land or someone else's. For example, at a shopping mall, they install those dumb stop signs. Unless the mall has given right of enforcement to the state, the stop signs are unenforceable. They are only relevant to a negligence, civil, action.
These are general rules, and may not apply to every single state.
