Is Obamacare Still The Law?

The White House quietly unilaterally repealed the Obamacare individual mandate for two years. That the President doesn’t have the authority to repeal provisions of a law passed by Congress doesn’t seem to matter anymore. The Republicans tried to pass an Obamacare delay as part of the budget impasse back in October. The President refused. One wonders what the point of negotiating with Obama is at this point. He seems to believe he is free to do anything he wants without negotiating with Congress. Obama wouldn’t give the House Republicans a crumb back in October, now he’s unilaterally done just what they wanted. His negotiations were disingenuous. So disingenuous is this President that he’ll veto a law requiring him to follow the law.

ObamaCARE removes healthcare from the non-EXEMPT
who are not Moslems.

That was the plan.
It worked and will cost non-Moslem non-EXEMPT families
up to $20,000 per year if nothing goes wrong for them.
Otherwise, their home goes to Obama and the feds.

America is finished, along with the LAW and justice,
replaced by a corrupt IRS running medicine and surgery
of Americans, with the efficiency of DC and Obama.

I really like this opening paragraph. This is something that I've commented upon in a number of threads. 0bama has now delayed/repealed the various parts of 0bamacare that are EXACTLY what he (not the GOP) chose to "shut down the government" over just last October. And his unilateral actions are unConstitutional and a dereliction of his duty to follow the law.

I'd like to read the rest of your blog and perhaps trade comments with you about it. If you post it all here, 'gunner might even give you an FR blogger good housekeeping seal of approval. Welcome to FR.

The Affordable Care Act was never law, as it was unconstitutional when passed (having violated Article 1, Section 7 - "All Bills for raising Revenue shall originate in the House of Representatives...."). When the USSC found the ACA "constitutional" as a tax, they actually found it unconstitutional as all tax bills must originate in the House. Unconstitutional bills are void at passage, have no weight, and do not need to be obeyed.

Obama has good reason for wanting to get rid of the individual mandate. People simply aren’t buying overpriced Obamacare coverage. Odds are middle class Americans were not very enthused over Obama’s demand that we give up cell phones and cable television in order to pay for Obamacare premiums. It’s especially galling to hear for people who had perfectly fine catastrophic coverage that got canceled because of Obamacare. These people are looking at paying more per month and they have higher deductibles. The President’s response? Give up that cell phone because Obamacare is awesome. Shockingly no one is swayed.

Is there anything left of Obamacare? The President has unilaterally suspended the entire law. The employer mandate is gone until after the midterm elections. The individual mandate is gone and won’t be enforced until after Obama is out of office. Plans that were going to be “illegal” under Obamacare are suddenly legal for two more years if insurers can still offer them. Obama has essentially kicked the Obamacare problem to the next President. Very little of this law will be functioning by the time this President leaves office. In many ways Obama has repealed, unilaterally, his own signature law.

Progressives like Obama believe government is capable of managing the economy and specifically that it is capable of managing the healthcare industry. It’s obvious government is utterly incapable of managing this or any other industry. The notion that healthcare decisions are best made from on high in Washington has been completely destroyed by this law. People want more options than the three or four approved government healthcare plans. Before Obamacare those in the individual market hand hundreds of options to choose from. Today they have three because of Obamacare. Yes, several different insurers might offer those plans but the bulk of what’s in those plans is determined by “experts” in Washington. Individuals are bright enough to make their own decisions without paternalistic government experts telling them what they need.

This President has given up on his own signature law. For all intents and purposes Obamacare is suspended until Hillary or a Republican is living in the White House. The smartest man in the world couldn’t figure out how to manage Americans healthcare. Obama may be full of big ideas but he is incapable of implementing them. It isn’t just that he’s an incompetent manager, it’s that government is incapable of doing that which the market can do more efficiently and in a more satisfactory way. The market changes to meet the needs of customers. Government bureaucracy digs in and never changes because it has no profit motive. Obamacare was never going to work despite its roots in fascism. Private insurers cannot meet the demands of its customers when government limits what those insurers can offer.

Well said. You can't get anymore disingenuous than that! ("dishonest", "deceitful", "duplicitous", etc.; a harsher word is even more accurate)

It’s obvious government is utterly incapable of managing this or any other industry.

Truer words never said. Big government Socialists be gone!
