No judge at an effective level is going to allow any case of this nature to proceed. NSA knows everything about the judge, whichever judge he may be, and DHS or their contractors know where the judge's family members live and someone will remind him of these things. Chief Justice Roberts got turned. Any lower level judge can be turned. If the judge is not properly convinced then NSA info will be used to arrest him for something or to taint him.

It is not hopeless yet, but no portion of the government except some of the county sheriffs remains to us. And NSA or its controllers is pretty close to all-powerful in this nation and society.

Roberts was an unusual case. It's not often that Supreme Court Justices smuggle their kids into the US from foreign countries illegally. He was just dumb enough to get caught by the Chicago mob.
