I still have more respect for the Supreme Court than I do for Congress (i.e., the legistative branch) which abdicated their role in the 3-branches-of-government over 20 years ago in favor of hiding behind polls, committees, special prosecutors and, of course, the Supreme Court.
You are right. Congress wants wiggle room in the laws they pass and so they weave in vague ill defined terms. They then kick the can to the Supreme Court who will define those vague terms only when a case is brought before them (with standing) and then they will define the terms the way the political wind is blowing. And who can get two lawyers to agree on the time of day?
