Realized something this morning. The general consensus is, that the Employer Mandate is being delayed to preserve the Democrats' chances of winning the House in 2014
Now, despite the plain language in the bill requiring the Mandate be in place 1 Jan 2014, the one-year slip is going to be an issue.
BUT. . . of course, the Geniuses at the Most Transparent Administration EVER have forgotten something important, as is their usual level of "brilliance".
The WARN Act ( http://www.dol.gov/compliance/guide/layoffs.htm ).
You know. . . the one that requires companies with more than 100 employees to give 60 days notice of impending layoffs ???
Look at the 2014 Calendar. 60 calendar days prior to Jan. 1, 2015 is Sunday, Nov. 2, 2014. So layoff notices need to be in the hands of employees not later than close of business, Oct 31, 2014. Election Day is Tuesday, November 4, 2014.
Ooopsie. . . . .
They will ignore the WARN Act penalties like they did with the military contractors before the 2012 presidential elections.
Except. . . there are a lot of smaller businesses out there who WILL layoff, but won’t get an exception. . .
The employer mandate still exists for months after 12/31/2013. The requirement still exists because it is a law only the enforcement/punishment went away.
I guess I am more cynical. If is politically expedient to the Rats, I think they will issue guidance through the DOL, HHS, IRS or whoever, that will suspend the WARN requirements based upon ... because they say so, and advising that anyone who goes ahead with notices anyway will get extra attention from the regulatory and tax agencies.
