As executive enforcement of what existing law? This would be an order with no basis in law and no (apparent) means of enforcement. Who will enforce it? In McClean County in IL there is a states attorney who has declared he will not enforce any existing state laws that he believes are inconsistent with Heller. We need many more such commitments. Obama is trying to expand executive power by stretching executive “discretion” well past its legitimate boundaries. We also have many pockets of “discretion” that can act as buffer zones against these encroachments, and we need to start using them. It shouldn’t be too hard, either. An EO is just a piece of paper with some ink on it. If it has no legal force, and it is widely known to have no legal force, I should think we would have many allies in dismissing it as a nullity.
