Since it's now a TAX (not "healthcare"), are waivers invalidated? (vanity question)

Isn't there some sort of legal precedent that taxes have to be applied equally? Does yesterday's ruling invalidate the "waivers"?

I think you are onto something here. This is what you end with when you enact a law with legislative intent expressed in one direction and then completely switch gears after it is signed into law. You wind up with scrabbled eggs.

I am not certain, but IIRC, the waivers were time-limited. I suppose they can be renewed in a rolling fashion, but again, not certain that would satisfy the Equal Protection clause.

After January 2014, the first people who are negatively affected by this law can sue.

Incoming POTUS Romney issues a blanket waiver for all taxpaying US citizens and their dependents.

Were those waivers on the mandate to carry a minimum coverage, or were they on the excise tax on the “cadillac” plans?

You are absolutely correct! You can’t choose who you want to tax and not tax! Course Obama will still try and likely get away with it seeing he gets away with everything.

People are taxed unequally all the time.
Mever heard of tax abatements giving special preference to certain businesses?
Been going on for decades.Never been right but its been legal.
Ot tax rebates for buying certin cars,homes, solar panels,etc.?

Every waiver ought to be canceled post haste. No sweetheart deals for Starbucks and McDonalds and the hundreds of other companies that made deals with the snake in the White Hut.

Anyone on waiver is now classified as a loopholer. Classifying this as a tax has turned this into a Giant Turd sandwich and the Zero took the first bite he just doesn’t know it yet.

Add Congress, Senate and the One to this list as well....they certainly shouldn’t be given any other healthcare than what they gave us.

Local Gov’ts give property tax breaks all the time to bring in new industry. There are all kinds of carve outs in the income tax code. Question is does IRS have right to add the waivers or does Congress have to pass tax law. Given the Obama Chicago approach to government I’d say they will at least try to incorporate the waivers into the tax code by executive order.

It’s a good question. But the answer is, as long as Obama is president, and the courts enable this president, realistically, this president will continue to do whatever the h*** he wants to, and will push the envelope in other areas, based on this court precedent.
