From $94 billion to $1.6 trillion...

President Obama has repeatedly asserted that the new health care law's individual mandate requiring everyone to have qualified health insurance coverage or pay a penalty is not a tax. 

In a testy exchange with ABC's George Stephanopoulos--who, ironically, also pushed for sweeping health care reform legislation when he worked for then-President Bill Clinton--Stephanopoulos pointed out that ObamaCare critics call the mandate a tax.

Obama rejected the claim and noted that his critics call everything a tax: "For us to say that you've got to take a responsibility to get health insurance is absolutely not a tax increase." -Forbes

So Obama SWORE up, down, and sideways that the mandate WAS NOT A TAX... now it is, and in fact the largest tax increase in US history

Also, the Medicare provision appears very problematic for the bill... the state exchanges can't be forced upon the states like ObamaCare needs to work.  Remember Christie refused to do it until the ruling... WELL, he won today- and other states can tell Obama NO too.

That's seems as disabling as if the mandate was shot down... innit?

Is there a specific amount or formula for arriving at the amount of tax that must be paid in the law? If there is not this is all moot since the SOLE power to raise and collect tax is given in Article One to the Congress not to any department secretary.

How is the mandate justified as being a “tax”. It wasn’t presented as a tax when the bill was signed. It was called a “penalty” that would be levied if you didn’t purchase health insurance? Is this simply a game of semantics? Can someone clarify this?

4 years ago, I posted here that our government was irreparably broken. I was told that I was nuts and didn’t know what I was talking about.

Perhaps now the folks at FR will believe me.

We have few choices left to us as the result of this ruling and none of them are good. My suspicion is that our complacency will overcome our desire to be free and we will, as we have done so many times in the past, bend over and just take it.

The IRS collects the taxes but Congress passes the rates. Unless there is a specific formula or amount in the bill the tax is dead until Congress passes the rate. The IRS and the Executive do not create their own rates.
