America has witnessed an stunning rise in drunk driving fatalities committed by illegal aliens - many of whom had previous criminal records and even prior DUIs - yet remained free in this country to drink, drive and kill Americans. This has always been a problem - with both Federal officials and local law enforcement dropping the ball. But thanks to new, relaxed deportation guidelines of Immigration and Customs Enforcement (ICE), the numbers have increased to record levels in the past two years.

In August 2010, Sister Denise Mosier, a Benedictine nun (yep, like The Sound of Music) was killed and two other nuns seriously injured in Virginia when Carlos Montano, an illegal alien from Bolivia, driving with a suspended license and with a blood alcohol level three times the legal limit, slammed his car into theirs. Montano had been arrested two other times on drunken-driving charges - and county police twice handed him over to federal immigration authorities. But he was released back into the public to commit his third, and fatal DUI. Montano was convicted of felony murder in February of this year - far too late for Sister Denise.

Montano's crime came mere days after ICE Director John Morton released a memo dictating new policies that the agency should shift the focus of their capture and deportation efforts on illegals who were suspected of terrorism, had been convicted of violent crimes or were repeat offenders, gang members or “aliens who otherwise pose a serious risk to public safety.” Clearly Montano does not fit ICE's new definition of a "serious risk" to public safety, despite two prior DUIs, as he had been slated for deportation - and instead was released (adding insult to injury, he was even given a work permit by DHS!)

The Mosier killing marketed a turning point under a broad Obama virtual amnesty which was at that point just beginning to emerge. On Stand With Arizona, we began to notice in our posts the growing body count of Americans killed by illegal alien drunk drivers with prior arrests and/or convictions, who were released by DHS or ICE to commit those crimes. And frequently state authorities also fail to enforce the law - whether through incompetence, or sanctuary city policies.

Now in Congress, Federal legislation has been re-introduced to mandate immediate deportation for any illegal alien convicted of DUI. It is H.R. 3808 - The Scott Gardner Act, introduced by Rep. Sue Myrick (R-NC) and Rep. Mike McIntyre (R-NC).

This story barely scratches the surface of what is going on. The truth is illegals drive without insurance, without valid drivers licenses, with fake IDs(usually at least 5) and nothing ever happens to them.

They drive drunk all the time and if they cause a traffic accident or injure or kill some one they consider themselves to be the victim. The people they hit or injure or kill have no recourse. The authorities protect the illegals and prevent them form being brought to justice.

All the things discussed in the article are already illegal. If you or I did them we would suffer severe consequences. Illegals do it all the time and nothing happens.

We don't need new laws. We need politicians who will enforce the law. The politicians in office today will not enforce the law.

Reality check:
The chance of passage of this legislation with the current Congressional makeup is zero.

Even if the Republicans retake the Senate in 2012, they probably won’t gain a supermajority to prevent ‘rat filibusters. So again, the chance of passage will remain zero.

it’s a good idea, though, and I would certainly support it.

Here in Palm Beach County, FL we had a beloved middle school teacher killed on her way to work. She was t-boned by a truck full of drunk illegals. AT 7:30 AM!! No license, no insurance.

I don’t want one tax dollar to be spent on housing these scumbags in jail. Get them out!

Why? We aren’t enforcing other existing laws about deportation are we? All this does is give another round of cover to the corruptocracy for the fall elections.

They are already here illegally. They are already breaking the law. This probably wasn’t the first time they drove drunk. They should be arrested and deported BEFORE they drive drunk and BEFORE they kill people. Our politicians won’t let us enforce the law. Passing this law would be great but with the current politicians in office it won’t make any difference.

This article and others just points out the ones that killed and got caught. If you ever lived in an area with a lot of “undocumented” (oops I left it in my native country) aliens you would also see the cost in insurance and out of your pocket. They think nothing of getting into an accident and just leaving the scene. My neighbor had to chase one down after getting rear ended but since he was uninsured it did no good. I stopped at a 7 Eleven and a group in a spivic hit my car pulling in. They just sped off and I could not catch them. Just one more way of leveling the playing field against those that play by the rules.

I favor this act with the caveat that the requirement for states to join the Driver License Agreement (DLA) is left out. Previous versions of the bill had the requirement but in this congress, it has been left out. The DLA would require states to open their driver DB’s to other states for access but the DLA also requires driver DB’s to be accessible to foreign countries as well like Mexico and Canada as a start !

Everyone here on FR needs to look closely at their vehicle insurance—no matter who your carrier is.

The cost of UNINSURED motorist insurance has skyrocketed in the past 10 years ++.

We all need to get after our own insurance companies to push for the removal of these illegals.

My coverage represents 34% of my total premium.

I don’t drink.
I last had a moving violation in the early 90’s.
I never got a DUI.
I last accident I had was in the fall of 1965. It wasn’t my fault, but it got charged to me. Still irks me.

Whenever an illegal alien kills someone in a drunk driving accident or something similar, here’s what I recommend:
What can we do about it? Here’s my standard post.

RICO —Citizen Recourse

Private persons and entities may initiate civil suits to obtain injunctions and treble damages against enterprises that conspire to or actually violate federal alien smuggling, harboring, or document fraud statutes, under the Racketeer-Influenced and Corrupt Organizations (RICO). The pattern of racketeering activity is defined as commission of two or more of the listed crimes. A RICO enterprise can be any individual legal entity, or a group of individuals who are not a legal entity but are associated in fact, and can include nonprofit associations.

Here’s what I’ve been pushing: it’s time to file Racketeering, Influencing, and Corrupt Organizations (RICO) lawsuits.

RICO lawyers could turn it around in a few years and MAKE MONEY at the same time. I’m surprised they haven’t done it already.

In the absence of enforcement, we can get the word out in the meantime that there is money to be made in filing RICO lawsuits against employers who hire illegal aliens like this jerk.

Employers would have no trouble shutting down the border if they could get sued by someone under the RICO statutes for hiring these people in the first place. The next time an illegal alien kills someone in a drunk driving accident or somesuch thing, I’m going to point out that the victim’s family might be able to seek compensation from the employer under these statutes in the hopes that it would catch on. If this did catch on, would see such a swift backlash against illegal immigration that no employer would go near these people and they’ll all simply want to go back home.

RICHMOND — A federal judge has blocked Prince William County’s pursuit of information on the more than 4,000 criminal illegal immigrants the county has turned over to Immigration and Customs Enforcement since implementing its controversial crackdown in 2007.

U.S. District Judge James C. Cacheris said that ICE responded adequately when it provided redacted documents on the subject to the county last year, and that the county failed to provide follow-up information to the U.S. Citizenship and Immigration Services (USCIS) to fulfill another request.

Prince William Board of County Supervisors Chairman Corey A. Stewart said the ruling earlier this month wasn’t unexpected — he said Judge Cacheris thought the county should have exhausted its administrative options before taking the case to court — but he blasted the federal government for shutting out the county and its residents from information they deserve to know.

“Why they continue to stonewall Prince William County, why they continue to stonewall our law enforcement, is inexcusable,” he said.

County officials began seeking the information after a high-profile incident in August 2010 in which Carlos A. Martinelly Montano, an illegal immigrant who twice had been convicted of drunken driving, was charged with killing a Benedictine nun while again driving drunk. Martinelly Montano was found guilty of felony murder in October and was sentenced to 20 years in prison in February.

In November 2010, the board submitted a Freedom of Information Act request to ICE for information on the illegal immigrants taken into ICE custody since Jan. 1, 2008.

ICE provided a three-page response Feb. 11, 2011, which included partially redacted spreadsheets for two of the county’s three requests: copies of records and reports of the individuals, and copies of their status or disposition. ICE explained that other files the board had requested were held by USCIS, and that the request was being turned over to that agency.

The court said the request referred to USCIS was “administratively defective” because the agency had requested additional information — written consent and verifications of identity for the individuals, including their alien number, name, date of birth and country of birth — that the county never provided.

County officials argued that the Congressional Privacy Act only applies to U.S. citizens, and ICE should not have redacted the files for the same reason — because the request concerned illegal immigrants who were not protected under privacy laws.

Believing they had exhaustedtheir administrative remedies, county officials sued in U.S. District Court for the Eastern District of Alexandria in August to obtain the records that were being withheld.
