The First Amendment does not guarantee the right to "occupy" a public place. Not using that exact word, but it does guarantee a right to peaceably assemble and to petition the government for redress of greivances, without time limit.
The First Amendment does not guarantee the right to steal.
The First Amendment does not guarantee the right to trash a Whole Foods store.
That's true.
It's also true that somebody did those things.
Be aware, though, that there are also reports that those things were done by a group not associated with the "Occupy Oakland" group, and that the Occupy Oakland group actually attempted to prevent it.
Ah, Evidence (Infiltrators Attempted to Coopt Oakland)

“This is happening in CITIES that have POLICE FORCES under the control communist retard MAYORS and largely populated by communist retard CITIZENS.”
That’s a good point that I didn’t consider when I wrote this. I can’t dispute that.

They didn’t exactly speak out against it, either.
Peaceably assembling does not mean shutting down ports, barring other individuals from buildings, etc.

Where in the Constitution did the States delegate to the Federal Government the authority to regulate the dealing of dope? The cops dealing with the OWSers are STATE police officers and may enforce STATE drug laws. There is no Constitutional provision forbidding STATES from making and enforcing drug laws.
National Guard mobilized to assist state police are mobilized by the Governor of the State in question and are state officers as such.

Actually I think the OWSers are doing a fine job of validating the tea party. They can keep doing all this stuff in public for all I care. They are embarrassing themselves and they don't realize we're laughing at them and not with them. They tried this shit in Wisconsin and it backfired. They're trying it in Ohio and hopefully it will backfire. America is starting to come to its senses.

You’re right.
But, as I said in Post 15, “Then why make any constitutional reference to it at all?”

these people want it to get violent. they want to provoke a response
my solution, garden hoses. not fire hoses which would toss them around like filth... just simple garden hoses that would get them wet...
while standing I. the cold... occupying the street
maybe add some sugar to attract (even more) insects
hehehe

Im not calling for violence. As I stated in the article, this should be peacefully resolved. As long as some skulls get busted in the process.
I haven't heard any of the local governments or police departments complaining that they can't handle the situation have you? So why the need for the National Guard?

Then why make any constitutional reference to it at all?A reasonable question, not posed before I replied.
You made an excellent point on Freedom to Assemble without the limitation of time.

Im not calling for violence. What's this, if not a call for violence?
It's time for the National Guard to come in and bust some skulls. Let me repeat that so there is no misunderstanding:
It's time for the National Guard to come in and bust some skulls.

Yeh I don’t think there’s enough national guard left over here to subdue anybody. Most of the state armory’s have been pretty much looted by the Feds for the overseas missions anyway.

Busting some skulls isn't really violence, per se. Just a colorful expression.
Anybody see that last Rambo movie? The NG opened up like he did, now that would be some violence.

Agreed. I just get tired of the military getting called in to clean up someone else’s mess. Get’s old.

Thanks for the save.
This isn’t the clearest thing I’ve ever written, I’ll grant you that.

Does Oakland or NYC look in control ? Yes. Certainly in control enough not to need troops in the streets.
