IN NC, he has survivors rights. He gets the money. Also she cannot have a condition in the Will that extends into the future unless she hid THEIR money in a Trust.

Thanks, I didn't think that it was legally binding to put that type of term in to a will.
Here' one for you...
A racist co-worker of mine wanted his will to prevent his daughter for recieving any money if she married a black man. His lawyer said it was not legal to do that.

My money is in a trust I received upon my mother’s death. Upon my death it passes to my husband. If he dies before I do or we die together it goes to our children.
