This story has been around for 3 years, but not one news report reveals the perp is an illegal alien. From local courts, all the way to the Supreme Court, taxpayers are saddled with the costs of his illegal incursion and defense. Below the article are court documents which finally reveal his status. As he awaits tax payer funded trials, he is NOT in the Jackson County Jail while thousands of alien Mexican drug cartel criminals continue to occupy US public and private lands.

Medford man in pot investigation pursues tracking device complaint to Supreme Court (Medford man???? NOT hardly!)

MEDFORD, Ore. -- A Medford man plans to take his appeal of a mobile tracking device all the way to the U.S. Supreme Court.

The attorney for Juan Pineda-Moreno believes a dissenting opinion in a federal appeals court ruling was the right one.

Police attached mobile tracking devices to a sport utility vehicle as part of a marijuana investigation in Southern Oregon that resulted in the arrest of Pineda-Moreno and others.

His attorney says his constitutional rights to privacy and protection against unreasonable searches and seizures were violated when federal agents attached the tracking devices while his SUV was parked on his property.

The 9th U.S. Circuit Court of Appeals rejected those arguments in a divided opinion, but a dissenting judge agreed with them.[snip]

On September 12, 2007, information from a mobile tracking device alerted agents that Pineda-Moreno's vehicle was leaving a suspected marijuana grow site.   Agents followed the Jeep, pulled it over, and smelled the odor of marijuana emanating from a passenger in the backseat of the vehicle.   The agents contacted immigration authorities, who arrested all three individuals in the vehicle for violations of immigration laws.   Pineda-Moreno subsequently consented to a search of his vehicle and home.   In Pineda-Moreno's trailer, agents found two large garbage bags full of marijuana. http://caselaw.findlaw.com/us-9th-circuit/1497005.html

The Washington Times - Wednesday, September 1, 2010 An indictment was handed down Aug. 30 by the Southern District Court of New York that shows a connection between Hezbollah - the proxy army of Iran and a designated terrorist organization - and the drug cartels that violently plague the U.S.-Mexico border.

In short, a well-known international arms dealer was trying to orchestrate an arms-for-drugs deal in which cocaine from FARC - the Revolutionary Armed Forces of Colombia, which works with Mexican drug cartels to take cocaine into America - would be traded for thousands of weapons housed by a Hezbollah operative in Mexico.

This most recent case brings up several questions: Why would a member of Hezbollah be in Mexico? Why would Hezbollah need thousands of weapons in Mexico? Why are members of Hezbollah willing to work with FARC? Perhaps to exchange weapons for drugs? If Hezbollah has guns in Mexico and wants drugs, isn't it logical to assume that it is trading with more accessible Mexican drug cartels?

This is just the most recent incident in which it's clear that Hezbollah may have a presence in Mexico and along our southern border. There have been more incidents - which have been ignored by the Obama administration and the Department of Homeland Security.[snip]

As much as I hate illegal immigration and drug dealers, the issue is really about whether the feds can attach a GPS device to your vehicle while it is in your driveway, on your property. The 9th Circuit Court, a lapdog for Big Brother, says "yes".

I don't agree, and freedom loving people should disagree, too. You want to search me, get a warrant....

[snip]Scouting deep within the steep, wooded wilderness of the sprawling N3 Cattle Ranch on July 21, three deputies shot Jose Penaloza-Soto, a landscaper from East Palo Alto. Deputies reported that the camouflaged 28-year-old did not drop his weapon when they spotted him and called out orders in both English and Spanish. In fact, he seemed to be aiming what clearly looked like a hunting rifle at a group of Alameda County sheriff’s deputies who were also on the raid. As officers advanced on the wounded man, he suddenly reached out to grab the dropped weapon and was shot once more, according to officials.

When they finally got to him, lying on a hillside of loose scree not far from an 18,000-plant illegal marijuana garden, Penaloza-Soto was dead.

Deputies estimate that there was about $60 million of marijuana ready for harvest within two well-hidden gardens nearby. Other suspects at the scene ran, deputies believe. Deputies heard them crashing away through the underbrush during the shooting. They have not been found.

The dead man’s family declined to be interviewed. But sheriffs reported that he was a Mexican national, here for slightly longer than a decade. He had worked for years with no criminal problems as a landscaper in the San Francisco area. Recently, his family reported, he had grown quiet and distant.
Marin Marijuana Farm Crackdown Nets $20 Million Of Pot

[snip]Sgt. Debra Barry said the plants, between 2 and 5 feet high, were spread over approximately 100 acres in the ridgelines and canyons surrounding Kent Lake in the Mount Tamalpais watershed. Dangerous chemicals, including rat poison, fertilizers and insecticides that pose significant dangers to pets and wildlife, public land and the water supply, were found at three clandestine grow sites, Barry said. The illegal cultivators also diverted water from natural springs, creating further danger to fish and wildlife. The growers also set up “improvised diversionary devices” used to disguise trails and injure people, Barry said. The growers’ encampments had tents, food, showering areas, camouflage clothing, personal items, and ammunition for .45-caliber handguns.

Madera County - $135 million worth of marijuana - that’s what drug agents found growing on private property in Madera County Wednesday. It is a record find for that county.

The grow was in a corn field, near Road 21 and Avenue 19.

It is a continuing problem across the Valley - Mexican drug cartels growing marijuana on acres of private property, and the land owners have no clue about it.

20-year-old Alejandro Castellanos, and 21-year-old Carlos Bailon-Martinez, both from Oaxaca, Mexico, were arrested.

They now face felony drug and weapons charges and are in the custody of immigration officials.

Federal, state and local police spent June and July tailing suspected growers, following pickup trucks down abandoned logging roads and watching Hispanic men appear in the trees and toss nylon sacks resembling grain feed bags into the beds.

They followed one suspect to a Fleet Farm in Green Bay, where he purchased six pairs of pruning shears. They watched another man purchase 9 mm ammunition at a nearby Wal-Mart, documents said.

In Wisconsin, the number of seized plants in grew six-fold between 2003 and 2008, a year when more than 32,000 plants were seized

Drug investigators believe Mexican cartels are largely responsible for the spike. Growing the drug here helps them get it to major American markets more quickly. They often import unskilled laborers from Mexico to help find the best land and tend their crops.

Cartel grow recruiters often look for people with family in Mexico so they can use them as leverage to keep the farmers working and quiet. If anyone betrays the farm, they go after the worker’s family, intelligence experts say.

Unlike domestic pot operations of years past, many of the plantations now growing on federal land are operated by Mexican drug-trafficking organizations who are well-financed and well-armed, the sheriffs said.

“The longer it goes on, the harder it will be for us to overcome,” Winters told Walden. “They are better funded than us ... There are more of them than there are of us.”

A separate 2008 NDIC report on cartel-related drug-trafficking organizations said the Federation cartel was active in Klamath Falls, and undetermined cartels were working in Medford and Roseburg.

The Justice Department’s 2010 national drug threat assessment concluded the operations “constitute the greatest drug-trafficking threat” to the nation.

You have a valid argument, HOWEVER, this is NOT about a US citizen. IF this foreign invader had been kept out, as he should have been, there wouldn’t be the question.

NO one would come to the defense of Joe American in the same spot and pay all his legal bills all the way to SCOTUS.

Prison fight likely gang-related

HOMINY - Two prisoners were treated at a hospital Thursday evening after a fight between a large number of Hispanic and American Indian inmates at Connor Correctional Center in Hominy, prison officials said.

Corrections spokesman Jerry Massie said the fight started in several housing units within the prison at about 5:15 p.m.

“It was an altercation between Hispanic and Indian inmates, probably gang-related,” Massie said. “Guards were able to get it under control. We think it was coordinated.”

Gangs force Oklahoma prison lockdown

[snips]OKLAHOMA CITY — Oklahoma prison officials said Friday they imposed lockdowns at a pair of state prisons after two inmates were stabbed and several others were injured in a series of gang attacks that appeared coordinated.

Coliver said the attacks involved Hispanic and Native American gangs at the prison, but investigators are still working to determine what sparked them.

“We don’t know for sure,” Coliver said. “We assume the beef is some kind of retaliation.”

Homemade knives and weapons, including a padlock placed inside a sock, were used in the attacks, which investigators suspect were coordinated with cell phones smuggled into the prisons, he said.

The two gangs have been feuding for at least two years after a massive fight at the Oklahoma State Reformatory in Granite left two inmates dead and 13 others injured.

“Right after Tyner was arrested last year, the Hispanics attacked the Indians simultaneously,” Coliver said, “presumably as a result of the Native American involved in the killing.”

In prison, the violence spread beyond affiliated gang members to include other Native American and Hispanic inmates, said Lynn Powell, the director of Oklahoma Citizens United for Rehabilitation of Errants.

“This has been going on for almost two years now,” said Powell, who meets regularly with current and former inmates and their families. “It just keeps flaring up and spreading, because now it’s not limited to just gang members. If you’re Native American or Hispanic, you’re going to be a target.”
