Bush could issue a pardon.

These convictions were of Texas law, in the Texas Court system, they don't implicate any powers of the federal government. (which is why the Supreme Court held that US treaty obligations were of no avail to this miscreant).

Apparently, according to a recent article, Bush injected himself into this matter by asking Texas to review the case.

But, of course, he remains silent on the matter of Border Patrol Agents Ramos and Compean. And on the matter of the remaining two Haditha Marines still waiting for charges to be dismissed.
