I'm working multiple sources and have this wrap up before I head off for the 4th of July. A source close to the Attorney General says that Garza is still the frontrunner. This source speculates that Cornyn has been asked to do interference for the President. A White House source tells me Garza is still at the top of the list for O'Connor, but Cornyn was there and people are being relatively silent on his situation. My primary source tells me Cornyn should not be discounted, but Garza is who the source has said all along for O'Connor, with the possibility of Edith Brown Clements. Third parties are telling me we'll start hearing about John Roberts again as well as Edith Brown Clements. Also, the media will begin looking at both Cornyn and Garza. The long and the short of it is we have no real clue right now and we do not want to buy into too many unsubstantiated rumors. Now, let me say this: sources in the press, in the White House, and in the Senate have all said (1) Rehnquist should be out and they are somewhat surprised he is not; (2) Garza is the most credible O'Connor replacement; and (3) President Bush loves to play wild cards and Cornyn is a wild card. Cornyn makes sense from both a wild card perspective and from a conspiracy perspective (you know, Bush controls Governor Perry so Karl can move to the Senate). Garza has been the most widely circulated name with Edith Brown Clements flying under the radar and the odds are still good for him. It would make sense for Cornyn to be running interference. He is well liked by members on both sides of the aisle and would have familiarity with Garza from their days down in Fifth Circuit territory.
We do know that the President will not formally pick anyone until he returns from the G8. In the meantime, this is the perfect opportunity for the White House to throw a bunch of names out there and see who sinks or swims on the Sunday morning talk shows.
We know one thing for sure -- this thing is open and the battle is going to be hard fought.
As for Gonzales? I got a cryptic email from someone who works with Gonzales. He rules out Gonzales and says Gonzales knows this is not his time.
Update [2005-7-1 17:3:47 by Erick]:Last week Bill Frist gave three names to Harry Reid. Garza was on the list and is rumored to have been at the top of the list. Reid rejected all three names as unacceptable. Frist advised the President to prepare for a fight. The President intends to fight. Source on this is not my usual source, but is trusted.

Seriously, how Conservative is Garza? I know he is against Roe v Wade and is for Gun Rights, but how would he compare to Scalia, Thomas, and Rehnquist? How Strict a Constructionist is he?
What do you think of Garza as a judge?
Is Garza going to be solidly in the Thomas, Scalia, Rehnquist court?
Rules him out for me ... I want someone that the left will truly hate!!! ... I would recommend Ambassador Alan Keyes! Is he even eligible? Probably not ... but that's the "right" sort of candidate that I think Dubya should put in there.
Bush needs to send up Mark Levin first to mete out as much damage as possible on the "good" names of senators like Kennedy, Leahy, Biden, Schumer and Durbin. Then he can send up his real candidate.
How many of the people such as Cornyn, Gonzales, Olsen, ect. would have to recuse themselves from cases after having been in positions advocating one way or the other while in government positions?
May I take the liberty of repeating this. To do so will be a waste of time and energy.

Love to see the President nominate Mark Levin. Mark doesn't take any crap from anybody. The confirmation hearings would be well worth watching.
I think that Bush can really hurt the Democrats if he hangs tough. My strategy:
Nominate Janice Rogers Brown. The Dems are guaranteed to filibuster. Let 'em, then withdraw the nomination.
Nominate Miguel Estrada. Another filibuster. Again withdraw the nomination.
Nominate Edith Jones. A third filibuster, because all 3 are strong, solid conservatives.
After the 3rd filibuster, announce that he's sent three very well qualified and diverse candidates, yet clearly the Democrats are not operating in good faith. "Three strikes and your out." Because of the extraordinary obstructionism of the Dems, urge the Senate leadership to invoke the constitutional (nuke) option, and renominate Janice Rogers Brown.
She's confirmed, the Dems show their true colors by turning down a Black woman, a Hispanic male, and a white woman. Their less than totally partisan constituents will take notice, already a bit more open to rethink things based on the Kelo decision (I've heard numerous moderate and lowkey Democrats express suprise that the conservatives USSC members voted the way they did, and disappointment that the Dems took the side of the gov't taking homes for profit.)
Very big opportunity to educate more Americans about what the Dems are really about, to let them self-destruct, while still getting a solid conservative onto the bench. Fight the big battle and hurt the Dems now, because there is no guarantee that President Bush will be in a stronger position down the road.

Just be glad Aztlan Gonzales is off the list, because if he were nominated he'll spend the next 30 years pulling Penumbras out of a hat.

Gonzales would probably have the biggest problem. Olsen has been gone long enough that some of the issues will have aged out. And I'm not sure the rules are the same for non-executive branch people.
I think Bush should nominate either former MS Governor Ronnie Musgrove or former MS Attorney General Attorney Michael Moore. Yes these guys are Dems, but they are also pro-life and anti-gay adoption. I really would like to see how Ted Kennedy reacts to them.
