None of that was the case in the Georgia Ballot Eligibility Challenge where Obama or his defense team never showed up to confront the allegations made against them. The Judge ruled in team Obama’s favor after the Connecticut SS evidence was presented as well as experts testifying on the stand to explain Obama’s forged birth certificate.
The Georgia Ballot Eligibility case was civil matter. Allegations are made and the trail Court, under the Administrative Procedures Act, must assume the allegations made in the complaint are true until they are successfully defended.
Each defendant was offered a default judgment before trial because Obama did not appear as ordered. Each defendant waived their right to a default judgment and assumed the burden of proof for the allegations made in the complaint were true.
The Court found the evidence presented by the plantiff’s witnesses and evidence were unpersuasive in proving the allegations made in the complaint. Consequently, the Court ruled in Obama’s favor.
Again, OBOTS have successfully controlled the message the burden of proof is on those making allegations in a civil matter are on the plaintiff. They are not!
