It would appear that under Colorado law,a sleeping person cannot "consent" to sexual activities.He has apparently admitted,on tape,to having done just that.

Assuming that everything is,in fact,exactly how it appears in the story (which,I adamit,may *not* be the case)I'm not sure I have a lot of sympathy for the guy.

Heck, in some states, like Kalifornia, "consent" isn't even consent. "No" means No, and even yes means no as well, if the woman feels like changing her mind.
