Politico are reporting the treatment of Trump’s "fake electors" has varied wildly by state

Eighty-four Republicans in seven states falsely claimed to be Donald Trump’s presidential electors in December 2020. Three and a half years later, dozens of them are facing criminal charges that could land them in prison for years.

Dozens of others have not been charged at all.

Even though the fake electors all participated in the same scheme, some have been charged as dangerous criminals while others have been treated as mere dupes. These disparities depend almost entirely on where they live.

In Arizona, Michigan and Nevada, every fake elector is facing felony charges except one, whose charges were dropped in a cooperation deal. Their counterparts in New Mexico, Pennsylvania and Wisconsin aren’t facing any charges. And in Georgia, three fake electors have been charged alongside Donald Trump, while others struck immunity deals.

Meanwhile, an architect of the scheme across all seven states, Wisconsin lawyer Kenneth Chesebro, has only received what some experts call a slap on the wrist after he reached a plea deal in Georgia, and he hasn’t been charged in any other state. The attorneys general in Georgia and Arizona are the only state prosecutors to charge any of the alleged organizers of the scheme. At the federal level, special counsel Jack Smith cited Trump’s involvement in the fake electors’ project in his Washington, D.C., case against him.

Criminal intent - they fraudulently claimed they were the certified electors from the state of Arizona. Only the Legislature can certify electors - and they did not certify these electors.

I believe there was criminal intent based on the steps they took to conceal what they were doing.

And whose side? Good grief. I’m on the side of not using hare-brained schemes.

They submitted the alternate slate of electors in case Congress refused to accept certain states electors because of the possibility of fraud in a state.

If they had thrown out a state’s electors that risked that state not having a say in the electoral college electing the president. The alternate slate of electors would have protected a state from that.

They openly submitted them to Congress; it was no secret scheme. Would a car thief go to the motor vehicle dept and try and submit an alternate registration KNOWING there is already a registration on file, and openly admitting it to the clerk?

That was the only reason they did it. There is/was no criminal intent.

I still do not understand what crime or crimes these so-called “fake electors” are alleged to have committed.

Every losing Presidential candidate will have appointed Elector-candidates who would, had he won, have received certificates of ascertainment and who then would have voted on December 14, 2020 in their State capitals for their candidate.

So, between November 8 and December 14, there certainly were would-be Trump Electors in every State that Biden won, waiting for instructions from their State Legislatures.

What did these people actually DO? Did they forge certificates of ascertainment and send fake electoral votes to the President of the Senate?

Uttering an opinion that they were rightfully appointed Electors certainly wouldn’t be a crime, right?
