Why should we assume that it is the judge that is wrong, rather than the prosecutors?

I don't know about Indiana law, but apparently "neglect of a dependent resulting in death" required intent which the prosecutor failed to prove. I think getting stoned while caring for a child does show intent to neglect.
The judge has a valid point. He didn’t want to re-define the meaning of murder. Good for him. This one is on the DA.
If she were driving drunk, there would be intent. Then I saw she was black and realized this is what reparations look like to some.
She should be hung.
The judicial system in Indiana seems to be going to the dogs lately, or should I say, that “rats.”
Not sure about Indiana law, but in Tennessee if you commit a crime after having voluntarily ingested alcohol or drugs being drunk or high there is no excuse.
Even if the alcohol or drugs made you commit the crime you made the decision to drink/take them.
We have perverse laws that allow people who chose to use a drug that specifically impairs them, to then commit a crime they claim they wouldn’t have committed if they had not had the bad drug / alcohol they had, and get away with not committing murder, when they kill under that influence.
This has always been wrong.
I believe if someone kills under the influence of a recreational use of a drug / alcohol, that you premeditated the crimes that you subsequently commit, period.
Use your alcohol or drug, but die in the electric chair if you kill another under that influence. I could be fine with stoning you to death, too.
Excellent! That is EXACTLY how I’ve always seen it, except I take it to being premeditated, because you wanted to lose control.
I had thought we just needed a federal death penalty for drug dealers. Maybe we need one for users who do certain things, too.
She’s black. Murder is just a misdameanor as part of their reparations.
Yep it’s why it was called a late term abortion logic doesn’t always work with them.
