A Virginia woman is still fighting to hold her city accountable after a sanitation truck damaged her car five months ago. Chavonne Grant said the city’s trash truck hit her 2007 BMW 328i parked outside her home in Norfolk, Virginia and caused major damage, but nobody has been held responsible so far.
“There’s a gaping hole right here, the whole tire rod, the tire was flattened. The bumper was pushed up, but the bumper was on the ground. It’s completely cracked. … The hood had to be pushed down,” Grant told WAVY.

The Virginia woman said it was a neighbor who first saw the truck crashing into the BMW. The driver of the truck then apologized to Grant.
“He came out, he explained that he was covering a shift and he was moving too fast and over or underestimated my car,” Grant said.
The driver, according to Grant, also told her that the city’s insurance would cover damages. The Norfolk woman also said a third party adjuster was sent to survey the damaged car after she reached out to a city councilman.
Grant then received a letter stating that the city of Norfolk has sovereign immunity and would not be paying for repairs.

The city should just pay up, even if it’s just for the PR. A 2007 BMW 328 isn’t worth all that much anyway.
File a claim against the driver’s personal insurance.
Her lawyer needs to wise up and sue them under ‘eminent domain takings’. They need to pay for the ‘taking’ they did in trashing this lady’s car.
The Takings Clause of the Fifth Amendment to the United States Constitution reads as follows: “Nor shall private property be taken for public use, without just compensation.” In understanding the provision, we both agree that it is helpful to keep in mind the reasons behind it.

Weird. Never thought about that. Ours has always been from a private company.
I wonder about that as well.
Also when I have have had car accidents, my insurance company handled everything. My insurance company dealt with the insurance company of the other driver.
Maybe not all insurance companies do business that way? In any event I had my vehicles repaired, and then my insurance dealt with the other driver’s Insurance to be reimbursed.
She is at most a 3.5 on a good hair day. Let’s move on.
There was an occasion several decades ago when an Arlington County patrol car in hot pursuit chased a car thief across the Potomac River into the District of Columbia. Unfortunately, the police officer lost control of his car and struck a pedestrian, severing their legs. When sued by the victim, Arlington County tried unsuccessfully to plead sovereign immunity under Virginia law, which was held only to apply to acts occurring in Virginia.

He was never punished.
