A man who was 13 when he killed a four-year-old boy has been granted parole.
Eric M Smith was convicted of second-degree murder in 1994, and jailed for nine years to life.
A year earlier, he had lured Derrick Robie into the woods and struck him on the head with a rock in the New York village of Savona.
Smith first became eligible for parole in 2002, but Derrick's parents Dale and Doreen Robie opposed each of his 11 attempts.
On 5 October, he was successful and has been told he will be released as early as 17 November, the Department of Corrections and Community Supervision said.
As well as statements from the victim's family, parole boards look at a prisoner's criminal history, their behaviour in prison, the risk they pose to public safety, and the chances of them being able to successfully reintegrate into society.
During the trial, Smith's lawyer had tried unsuccessfully to argue that he was mentally ill when he strangled, hit and sexually abused Derrick, who had been walking alone to a local park.

Reintegrate. He was a kid so has no idea what society is. He only knows prison and will be back inside within six months after he's ruined a few more lives.
And hopefully dead on the 18th.
I remember this as well. This guy needs to be locked up until 10 years after he’s gone cold.
I wonder if this was the story I once heard when driving to NJ on business one rainy night. Some NYC (I think) local radio host, a woman, was really getting angry about a kid killing a kid. Only thing is I thought it was a 6yo or so who killed a very young toddler. And that is was in a house. But it’s been 25 years and I Never heard such story outside that radio show.
Someone like that, who obviously does stuff just to see what it’s like, is obviously some kind of psychopath.
He should be locked up forever, even if it’s just a criminally insane institution. Oh wait, it’s not nice to have asylums.

The boy’s family should now take their revenge. And don’t rush his demise.
I remember this POS. Although underage he was so vicious he went to prison and deserved to go. I do not see how he could have developed human empathy in prison when he apparently had none when he lured that child to murder him.

He is at least 40.
It seems like it they thought he was rehabilitated they would have paroled him around age 30. Police say once a person reaches 30, the likelihood of crime is much less.
The fact they waited until 40 is a red flag that they either messed up 10 years ago, or they are messing up now. How do you start a life at 40 when 2/3rds of your life has been behind bars?
Maybe he is reformed.
But, the risk to society is too high. He killed a person. Should he not be reformed, the result will be: another dead person.
IMHO, nobody who has killed a person should ever be released from prison. The risk to society is too high.
