The Constitution does not forbid such a move. It is actually silent on that particular point. So if the Senate moves ahead with Trump’s trial, I suspect the Supreme Court will hear an objection to the trial - and for the reason you just mentioned.

What will the Supreme Court do? I’m no expect on this, but my bet is that they will let the trial go forward. And that’s because the Supreme Court tries not to interfere in Congressional procedures.
