F1 Visa Holders Exempt from FICA Taxes (Social Security)

In general, non-US citizens employed in the United States are required to pay FICA taxes. However, those with single intent (i.e. expected to return back to their home country post their intended purpose in the US), or non-immigrant status (or F1 visa holders) are exempt from FICA taxes.

IRS guidelines confirm that F-visas, J-visas, M-visas, Q-visas, Nonresident Alien students, scholars, professors, teachers, trainees, researchers, physicians, au pairs, summer camp workers, and other aliens temporarily present in the United States in F-1, J-1, M-1, or Q-1/Q-2 nonimmigrant status are exempt from FICA taxes on wages paid to them for services performed within the United States as long as such services are allowed by USCIS for these nonimmigrant statuses, and such services are performed to carry out the purposes for which such visas were issued to them.

Sorry -- I was unclear in my post, and posted confusing/contradictory information in my last sentence.

My point was that these are mainly student/training visas that are intended to be temporary. Your Pakistani guy was probably working as part of a "professional training/exchange" program. I'm not sure which of the four visas listed in the main article he was working under, but I'm sure it was 100% legitimate.

OK here is the lowdown.

F1 OPT employees to NOT pay FICA taxes. Their employers don’t have to match their FICA taxes. Nor do they pay any state or local income taxes.

H1B employees pay ALL of those. Even though they might never collect SS. Nonsensical I know, but that’s your US Government for ya.

I know this because I’ve talked to people who employed F1 people who then switched to H1B and got upset/demanded raises when they had to start paying the same taxes as the rest of us.

It is an issue though as the employer is exempt from their portion of the taxes giving an incentive to hire foreign over USA workers. The playing field is not level.

What type of visa?

Was he a resident (student) or an attending?

True — but the employer has to find a foreigner who is here on a student/training visa. In most fields that’s not easy, and most employers have an incentive NOT to hire someone who is likely to be temporary and will have to be replaced by a new hire anyway.

That's a big "might" there. I believe they ARE eligible to collect SS, but only if they stay here.

H1B is good for three years. It can be renewed for another three. After that time you either need to have a green card in the system of leave. No guarantees you can stay but must pay FICA taxes anyway.

I think the thing behind F1 not paying them is that the program started as one year of “practical training” so that they can learn to apply what they’ve studied and then take it back to use in their home countries. One year became three, which becomes forever.

Why won’t they collect the benefits? Is it against their religion?

Different subject - i sometimes hear people say illegals help prop up SS because they pay in (using stolen SS numbers) but won’t ever collect. My response is “don’t count on it”. The libs will see to it that they collect - all in the name of “fairness”.

I agree with you that the illegals will collect. They get legal status, and then collect under SSI rather than OASDI.

The benefits are not as high but the children collect too. I’m a retired CPA and see the huge EIC refunds, the college credits after spending loan $$, and the refundable child tax credits. They make $$$ in refunds with zero paid in.

The Amish are required to pay on a non Amish employer even if they are 4029 exempt on religious grounds. 4029 exempt are exempt from SE tax if self employed and FICA taxes if an Amish employer.

They marry a US citizen and then the children collect on the mother.

They go for SSI rather than OASDI THUS no covered years required.

I’m a CPA and actually won a tax court case years ago for my client’s airfare and lodging in Italy.

The IRS claimed it was a vacation. My client claimed it was an employee recruiting expense. We won!

No. Foreigners should not get Social Security benefits
and they should still pay the taxes or an equivalent tariff.

It is a Tariff on visa foreigbers to create a level playing field.

This is why mass migration creates a mess.

Mass migration is really just an invasion by privilege.

It violates the 13th Amendment.

Tariff all visa migrants. Tariff the Social Security equivalent. Producers want unfair privilege.
