Struggling presidential candidate Beto O'Rourke said he would use the criminal code to back up his proposal of confiscating AR-15s from law-abiding Americans.The former Texas congressman elaborated on his policy in a CBS News interview:"If we're able to pass mandatory buybacks and I'm able to sign that into law, then I fully expect our fellow Americans to turn in their AR-15s and their AK-47s."O'Rourke continued, adding that there would be criminal consequences if people refused to give up their weapons:

I think Ill drive down Route 4 today and stop at Lexington Battle Green. Once there, I shall stroll out onto the grass (even though its raining today) and take a knee among the spirits of those who knew how to respond to gun confiscation. And pray that others remember where they left their spines.
Why doesn’t ButtHo’le Rourke use criminal code to take care of drug trade, human trafficking, and gang violence?
Beto is no longer running for President. He is vying for a spokesman/MSNBC/talkshowhost down the road. Simply cutting out a
niche for him to reside in the years ahead.

Agree. Texas hasn’t voted democrat in statewide offices for some time now.
I think the Constitution, specifically the 2nd Amendment (in a document called the bill of rights) may override that.
