There is a lot to unpack in a decision today by the Director of National Intelligence to declassify (with redactions) a 2018 FISA court ruling about ongoing unauthorized database search queries by FBI agents/”contractors” in the period covering 2017/2018.

BACKGROUND: In April 2017 the DNI released a FISA report written by Presiding Judge Rosemary Collery that showed massive abuse, via unauthorized searches of the NSA database, in the period of November 2015 through May 2016. Judge Collyer’s report specifically identified search query increases tied to the 2016 presidential primary.  Two years of research identified this process as the DOJ/FBI and IC using the NSA database to query information related to political candidates, specifically Donald Trump.

What is really scary is that law enforcement can collect the information illegally, then use it to figure out who they want to target.

They would not bring the illegal information to court—they would collect that (already known) data by other means.

The criminal court judge and defense attorneys would have no way of finding out what happened.

Any law enforcement officer who used this technique should do hard jail time.

No one will be arrested. Nothing was illegal. It was only “improper.” Perhaps a little etiquette training will provide a remedy this minor error. Nobody is perfect.

Is this supposed to make it sound like the Trump administration was using illegal surveillance methods? Yikes, these illegal surveillance methods were being used by the FBI and CIA AGAINST the Trump administration.

The March 27, 2018, Submission, as amended by the September 18, 2018, Submission, is subject to review by the Court under Section 702 of the Foreign Intelligence Surveillance Act (FISA) as amended, codified at 50 U.S.C. § 1881 a. The government's request for approval of the amended certifications and related procedures is granted in part and denied in part for the reasons stated in this Memorandum Opinion and Order.
